Օրենսդրական նախաձեռնություն տուգանքների մասին իրազեկումների վերաբերյալ:
Հարգելի գործընկերներ, քիչ առաջ շրջանառության մեջ դրվեց իմ կողմից օրենսդրական նախաձեռնության կարգով ներկայացված «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգրքում փոփոխություններ կատարելու մասին ՀՀ օրենքի նախագիծը: Աշնանային նստաշրջանի մեկնարկին նախագծի քննարկումն ապահովելու համար անհրաժեշտ ժամկետների պահպանման նպատակով այն ներկայացվում է որպես պատգամավորական նախաձեռնություն, սակայն նախագծի վերաբերյալ աշխատանքային քննարկումներ եղել են կառավարությունում, ուստի նախագիծը ներկայացվում է ՀՀ կառավարության հետ համատեղ:
Նախագծի կարգավորման հիմնական առանցքը, իրազեկումների առավել հստակ ընթակարգ սահմանելն է: Մասնավորապես, գործող կարգավորմամբ, ՎԻՎՕ 283 հոդվածի 6-րդ պարբերությունը սահմանում է, որ ճանապարհային երթևեկության կանոնների վերաբերյալ մի շարք «իրավախախտումների վերաբերյալ գործերով ընդունված որոշումները համարվում են հանձնված (ստացված) նաեւ, եթե անձը, որին ուղարկվել է որոշումը, ՉԻ ԵՂԵԼ տրանսպորտային միջոցի գրանցման (հաշվառման) կամ վարորդական վկայական ստանալու կամ վարչական իրավախախտման վերաբերյալ արձանագրություն կազմելու ժամանակ իր կողմից նշված հաշվառման (գտնվելու) կամ բնակության վայրում կամ ճիշտ չի նշել հասցեն կամ հրաժարվել է ստանալ ուղարկված (հանձնվող) որոշումը»:
Նախագծով առաջարկվում է հետևյալ կարգավորումը.
«Սույն օրենսգրքի 224-րդ հոդվածի երկրորդ մասի 2-րդ կետում նշված հոդվածներով նախատեսված իրավախախտումների վերաբերյալ գործերով ընդունված որոշումները պետք է հանձնվեն անձամբ հասցեատիրոջը: Որոշումը համարվում է անձամբ հանձնված, եթե դրա ստացման մասին անդորրագիրը ստորագրված է անձամբ հասցեատիրոջ կողմից, կամ հասցեատերը որոշումը ստանալու անդորրագրի վրա ստորագրել է որոշումը ստանալուց հրաժարվելու մասին։ Եթե անձը, որին ուղարկվել է որոշումը, տրանսպորտային միջոցի գրանցման (հաշվառման) կամ վարորդական վկայական ստանալու կամ վարչական իրավախախտման վերաբերյալ արձանագրություն կազմելու ժամանակ ճիշտ չի նշել հասցեն կամ նրա հայտնած հասցեով ուղարկված որոշումը վերադարձվել է կամ հասցեատերը հրաժարվել է ստանալ ուղարկված (հանձնվող) որոշումը և ստորագրել հրաժարվելու մասին, ապա որոշումը ՈՒՂԱՐԿՎՈՒՄ Է այդ անձի հաշվառման հասցեով, ինչպես նաև ՏԵՂԱԴՐՎՈՒՄ Է Հայաստանի Հանրապետության հրապարակային ծանուցումների պաշտոնական ինտերնետային կայքում»:
Իրազեկումների կամ ծանուցման այս մոդելը գործում է նաև դատական ծանուցումների դեպքում, մասնավորապես նմանօրինակ եղանակով ծանուցում նախատեսված է ՀՀ քաղաքացիական դատավարության օրենսգրքի 78-րդ հոդվածի` 2014 թվականի հուլիսի 3-ին ուժի մեջ մտած լրամշակված տարբերակում,- իր ֆեյսբուքյան էջում գրել է ՀՀ ԱԺ պատգամավոր Արփինե Հովհաննիսյանը:
