Մարդու իրավունքների Եվրոպական դատարանի որոշման առանձնահատկությունն այն է, որ դատարանը երկուստեք հավասարակշռել է` մի կողմից ՀՀ քաղաքացու բողոքն ընդդեմ Ադրբեջանի, մյուս կողմից՝ Ադրբեջանի քաղաքացիների բողոքն ընդդեմ Հայաստանի: «Sputnik-Արմենիա» ռադիոկայանի հետ զրույցում ասել է իրավաբանական գիտությունների թեկնածու Եղիշե Կիրակոսյանը՝ խոսելով ՄԻԵԴ-ի՝ արցախյան ազատամարտի հետևանքով ունեզրկված անձանց սեփականության իրավունքի և փոխհատուցման մասին որոշմանը: Իրավագետի խոսքով՝ այս որոշման մյուս առանձնահատկությունն այն է, որ շատ անմիջական է կապը Արցախի հակամարտության կարգավորման հետ:

«Եթե խոսում ենք Չիրագովի գործի մասին, ապա փաստացի ճանաչվում է Հայաստանի իրավազորությունն այդ տարածքների, մասնավորապես՝ Բերձորի նկատմամբ, և որի հիման վրա դատարանն ընդունեց իրավազորությունը: Սա արդեն իսկ որոշակիորեն անդրադառնում է Հայաստանի Հանրապետության՝ ԼՂ հակամարտության կարգավորման գործում որդեգրած դիրքորոշման վրա, քանի որ Հայաստանի հիմնական մոտեցումներից է տարանջատել ՀՀ-ն և ԼՂՀ- ն, և Արցախը ներկայացնել ինքնուրույն սուբյեկտ»,-մեկնաբանել է նա:

Իրավագետը բնական է համարում, որ «Չիրագովի հայցն ընդդեմ Հայաստանի Հանրապետության» ներկայացվել է Հայաստանի, այլ ոչ թե ԼՂՀ-ի դեմ, քանի որ ԼՂՀ-ի դեմ ներկայացված բողոքը դատարանն ուղղակի չէր ընդունի:

«Հետեւաբար՝ բողոքը ներկայացվել է Հայաստանի դեմ, որպեսզի դատարանը կարողանա քննել և հասկանալ, թե Հայաստանի Հանրապետությունն իրավազորություն ունի: Հակառակ կողմի հիմնական փաստարկն այն էր, որ Հայաստանի և Լեռնային Ղարաբաղի միջև կա անքակտելի կապ, և Հայաստանն իրականցնում է որոշակի վերահսկողություն: Խնդրո առարկա իրավախախտումները տեղի են ունեցել մի տարածքում, որը միջազգայնորեն ճանաչված չէ և չի մտնում Հայաստանի Հանրապետության սահմանների մեջ: Հետևաբար՝ պետք է հարց առաջանա, թե որքանո՞վ է դատարանի իրավազորությունն այստեղ կիրառելի»,-նկատել է բանախոսը:

ՄԻԵԴ-ի իրավազորությունը տարածվում է միայն իր կոնվենցիայի անդամ պետությունների տարածքների նկատմամբ:

Հետեւաբար՝ խոսվում է դատարանի արտատարածքային իրավազորության մասին: «Այստեղ ունենք երկու անդամ պետություն` Հայաստան և Ադրբեջան: Եւ այստեղ խնդիր է առաջանում որոշել, թե պետության տարածքը ո”րն է: Եվ դրանից էլ առաջանում են խնդրահարույց և քաղաքական վիճաբանությունները»,-ասել է Կիրակոսյանը:

Դատարանը վճռի կայացումը հետաձգել է տասներկու ամսով՝ կողմերին հնարավորություն տալով բանակցային ճանապարհով սահմանել երկուստեք ընդունելի փոխհատուցման չափը: Իրավագետի պարզաբանմամբ՝ տասներկու ամսում «լեզու չգտնելու» դեպքում, դատարանի վրա է ընկնելու պարտականությունը` սահմանելու արդարացի փոխհատուցում, նյութական և ոչ նյութական վնասների չափը:
