«Ժողովուրդ». Ինչո՞ւ սնանկ ճանաչվեց ՀՀԿ-ական պատգամավոր Սպարտակ Մելիքյանը

««Ժողովուրդ»-ը պարզեց, որ 2015թ ապրիլի 8-ին Աբովյան քաղաքի բնակիչ Կարապետ Օհանյանը դիմել Կոտայքի մարզի ընդհանուր իրավասության դատարան՝ պահանջելով ՀՀԿ-սկան պատգամավոր Սպարտակ Մելիքյանին սնանկ ճանաչել: Իսկ ինչ հիմքով է քաղաքացի Օհանյանը դիմել դատարան: Տեղեկացանք, որ վերջինս դատարանում հայտնել է, թե 2011 թ օգոստոսի 19-ին Երևան քաղաքի Նուբարաշեն և Էրեբունի վարչական շրջանների ընդհանուր իրավասության դատարանը որոշում է կայացրել Սպարտակ Մելիքյանից հօգուտ իրեն բռնագանձել 6 միլիոն 520 հազար դրամ: Սպարտակ Մելիքյանը չի կատարել դատարանի վճռով հաստատված պահանջը: Արդյունքում, Կարապետ Օհանյանը հաշվի առնելով օրինական ուժի մեջ մտած վճիռը՝ հղում է կատարել «Սնանկության մասին» ՀՀ օրենքի 3-րդ հոդվածին և խնդրել է, որ Սպարտակ Սելիքյանին ճանաչեն սնանկ:

 Իսկ ինչու պետք է Աժ ՀՀԿ-ական պատգամավոր Սպարտակ Մելիքյանը քաղաքացի Կարապետ Օհանյանին վճարեր 6 միլիոն 520 հազար դրամ: Պարզվում է, որ 2011 թ փետրվարի 24-ի վաղ առավոտյան Կարապետ Օհանյանն իրեն պատկանող «OPEL VECTRA» մակնիշի 14 ՕՍ 574 պետհամարանիշի ավտոմեքենան հանձնել է Սպարտակ Մելիքյանի հորը՝ Սեյրան Մելիքյանին:

Հենց այդ օրը տեղի է ունեցել ավտովթար, որի հետևանքով պատգամավորի հայրը՝ Սեյրան Սելիքյանը, մահացել է: Արդյունքում ամբողջովին ջարդվել է նաև Կարապետ Օհանյանին պատկանող «OPEL VECTRA 1,6» մակնիշի ավտոմեքենան: Եվ, ահա, դեպքից 1 ամիս հետո Կարապետ Օհանյանը դիմում է պատգամավորին և հայտնում, որ տեղի ունեցած վթարից իր մեքենան ամբողջովին վնասվել է, իսկ ինքն առանց մեքենայի չի կարող ապրուստի միջոցը հոգալ, քանի որ ամուսնացած է և իր խնամքին է բազմանդամ ընտանիքը: Ուստի խնդրել է հատուցել մեքենայի արժեքը կամ նմանատիպ այլ ավտոմեքենա տրամադրել:

 Սպարտակ Մելիքյանը, սակայն, նրան մերժել է, և Կարապետ Օհանյանը, այլ ելք չունենալով, դիմել է դատարան, որպեսզի դատարանի միջոցով կարողանա ստանալ իր գումարը: 2011 թվականին էլ դատարանը որոշել է պատգամավոր Սպարտակ Մելիքյանին պարտավորեցնել, որ վճարի Կարապետ Օհանյանին 6 միլիոն 520 հազար դրամ: Ինչպես նկատում ենք՝ 2011 թվականին հրապարակված վճռից անցել է 4 տարի, սակայն պատգամավորն այդպես էլ չի կատարել դատարանի վճիռը, և Կարապետ Օհանյանը, հերթական անգամ դիմելով դատարան, այս անգամ էլ պահանջում է, որ Սպարտակ Մելիքյանին սնանկ ճանաչեն»,–գրում է թերթը։
