Շանթ Հարությունյանի գործով դատավարության ժամանակ բողոքի ակցիայի մասնակիցներից Հայկ Կյուրեղյանը օդամղիչ ատրճանակից կրակեց, ինչի հետևանքով հարուցվեց քրեական գործ, ընթանում է դատավարություն: Օգոստոսի 25-ին մեղադրող դատախազը Հայկ Կյուրեղյանի համար պահանջեց 14 տարի ազատազրկում, ինչն էլ մեծ իրարանցում առաջացրեց քաղաքացիական հասարակությունում: Հասարակությունը չի կարողանում հասկանալ, ինչպես կարող է օրենքը նման անհամաչափ պատժաչափեր նախատեսել: Արդյո՞ք Հայկ Կյուրեղյանի արարքում հանրային վտանգավորության աստիճանն այդքան բարձր է:

Հայկ Կյուրեղյանի արարքի իրավաբանական որակման և պատժի համաչափության հարցի շուրջ Orer.am-ը զրուցեց «Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար, իրավաբան Տիգրան Սարգսյանի հետ: Ըստ Տիգրան Սարգսյանի՝ խնդիրն օրենսդրության մեջ չէ: Հայկ Կյուրեղյանի արարքը ճիշտ որակելու դեպքում նրա պատժաչափը անհամեմատ մեղմ կլիներ: Կայկ Կյուրեղյանի գործողությունները որակվել է ոչ ճիշտ` հանցագործությունների համակցությամբ՝ խուլիգանություն՝ որպես զենք օգտագործվող առարկայի գործադրմամբ (ՀՀ քրեական օրենսգիրք, 258-րդ հոդված, մաս 4) և իշխանության ներկայացուցչի նկատմամբ կյանքի կամ առողջության համար վտանգավոր բռնություն գործադրել՝ կապված նրանց կողմից իրենց ծառայողական պարտականությունները կատարելու հետ: Իրավաբանը նշեց, որ Վճռաբեկ դատարանի նախադեպային որոշման համաձայն՝ արարքը չի կարող որակվել խուլիգանություն, եթե բացակայում են խուլիգանական դրդումները: Այս դեպքում, արարքի դրդապատճառները շատ հեռու են խուլիգանական համարվելուց: Սա քաղաքացիական անհնազանդության բեմականացում էր, իսկ դրա նպատակը խնդրի շուրջ հնարավորինս մեծ հասարակական հնչեղություն ապահովելն էր: Ակցիայի նպատակի մասին նախքան գործողությունների դիմելը քաղաքացիական ակտիվիստը հայտարարել էր: Նման պայմաններում Հայկ Կյուրեղյանի գործողությունները որպես խուլիգանություն որակելը իրավաչափ չէ: Ինչ վերաբերում է արարքը 316-րդ հոդվածի 2-րդ մասով որակելուն (իշխանության ներկայացուցչի նկատմամբ կյանքի կամ առողջության համար վտանգավոր բռնություն գործադրել՝ կապված նրանց կողմից իրենց ծառայողական պարտականությունները կատարելու հետ), այստեղ նույնպես գործ ունենք արարքի սխալ որակման հետ: Տեսանյութից չի երևում, որ Հայկ Կյուրեղյանը կյանքի կամ առողջության համար վտանգավոր բռնություն է կիրառել: Տեսանյութից երևում է, որ արարքը պետք է որակվեր Քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով` իշխանության ներկայացուցչի նկատմամբ կյանքի կամ առողջության համար ոչ վտանգավոր բռնություն գործադրելու սպառնալիքի համար՝ կապված նրա կողմից իր ծառայողական պարտականությունները կատարելու հետ, որի համար ՀՀ Քրեական օրենսգիրքի համաձայն՝ դատարանը կարող է նշանակել տուգանք նվազագույն աշխատավարձի երեքհարյուրապատիկից հինգհարյուրապատիկի չափով կամ կալանք՝ առավելագույնը մեկ ամիս ժամկետով կամ ազատազրկում՝ առավելագույնը հինգ տարի ժամկետով:
