Սեպտեմբերի 28-ին փաստաբան Նիկոլայ Բաղդասարյանը դիմում էր ներկայացրել Հայաստանում Մարդու իրավունքների պաշտպանի գրասենյակ՝ իր նկատմամբ քրեական հետապնդումը «մարդու իրավունքների խախտում որակելու խնդրանքով:

Սեպտեմբերի 29-ին ՄԻՊ-ը հրատապ քննության կարգով ընդունել էր փաստաբանի դիմումը և Նիկոլայ Բաղդասարյանի դեմ հարուցված քրեական գործի վերաբերյալ տեղեկություն ստանալու նպատակով գրություններ ուղարկել ՀՀ Քննչական կոմիտե և ՀՀ Գլխավոր դատախազություն:

Այսօր Մարդու իրավունքների պաշտպան Կարեն Անդրեասյանի օգնական Շուշան Դանիելյանը Orer.am-ի թղթակցի հետ զրույցում տեղեկացրեց, որ ՄԻՊ-ը պետական մարմիններին ուղարկված գրությունների պատասխանները ստանալու վերջնաժամկետ է սահմանել հոկտեմբերի 21-ը:

«Մինչև հոկտեմբերի 21-ը մենք կսպասենք, և եթե մինչ այդ պատասխաններ չստանանք ՀՀ Քննչական կոմիտեի և ՀՀ Գլխավոր դատախազության կողմից, առանց սպասելու կհայտնենք մեր դիրքորոշումը՝ առանց սպասելու պետական մարմինների պատասխանին»,- ասաց Շ.Դանիելյանը:

Հիշեցնենք, որ Կարեն Անդրեասյանին ուղղված նամակում Նիկոլայ Բաղդասարյանը նշել էր, որ որպես պաշտպան՝ ինքը ՀՀ քրեական դատավարության օրենսգրքի 170-րդ հոդվածի համաձայն նախազգուշացված չի եղել քրեական գործից ստացված ապացույցը չհրապարակելու մասին: Ավելին, իրենից ստորագրություն չեն վերցրել և նախապես չեն նախազգուշացրել պատասխանատվության մասին:

Բացի այդ` տուժող կողմը չի միջնորդել, որպեսզի նիստը դռնփակ անցկացվի, ուստի, ՀՀ քրեական դատավարության օրենսգրքի 170-րդ հոդվածի համաձայն, ինքն իրավունք ուներ այդ փաստաթուղթը հրապարակել, որն էլ արել է, բայց, ըստ քննիչի գնահատման, այդ փաստաթուղթը փաստաբանը հրապարակել է ապօրինի:

Փաստաբանը օմբուդսմենին ուղղված նամակում նաև տեղեկացրել էր, որ այն գործողությունները, որոնց կատարման համար իրեն մեղադրանք է առաջադրվել ՀՀ քրեական դատավարության օրենսգրքով և «Փաստաբանության մասին» ՀՀ օրենքով, փաստաբանի գործառույթներ են: Ավելացնենք, նաև, որ Նիկոլայ Բաղդասարյանի դեմ քրեական գործը հարուցվել է Քրեական օրենսգրքի 144-րդ հոդվածով` անձնական կամ ընտանեկան կյանքի մասին տեղեկություններ ապօրինի հավաքելը, պահելը, օգտագործելը կամ տարածելը:
