Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովը մանրամասն քննարկել է Հայաստանի դատական իշխանության անկախության ամրապնդմանն ուղղված ժամանակակից մարտահրավերների բոլոր ասպեկտները` փորձելով դրանց տալ այնպիսի լուծումներ, որոնք կկարողանան որակապես նոր մակարդակի վրա բարձրացնել այն: «Արմենպրես»-ի հետ զրույցում այս մասին հայտնեց ՀՀ սահմանադրական դատարանի նախագահ Գագիկ Հարությունյանը` անդրադառնալով սահմանադրական բարեփոխումների նախագծում դատական իշխանության վերաբերյալ ամրագրված նոր դրույթներին:«Մեր առջև խնդիր էր դրված երաշխավորել ոչ միայն սոսկ դատական համակարգի անկախությունը, այլև արդյունավետ արդարադատության ապահովումը և դրա նկատմամբ համարժեք հանրային վերաբերմունքի ձևավումը»,- բացատրեց ՍԴ նախագահը:

Հարությունյանն առանձացրեց երեք առանցքային և արմատական հարցեր, որոնք լուծվել են սահմանադրական մակարդակում: Մանսավորապես, սահմանադրական փոփոխությունների նախագծի համաձայն` դատական օրենսգիրքը և Սահմանադրական դատարանի մասին օրենքը դառնալու են օրգանական օրենքներ և ԱԺ-ում ընդունվելու են ձայների 3/5-ով: «Սահմանադրական մակարդակով շեշտը դրվել է դատական համակարգի գործառույթների հստակեցման, ինստիտուցիոնալ փոխհարաբերությունների խնդրի արդյունավետ լուծման վրա: Ձգտել ենք ապահովել այնպիսի ընթացակարգեր, որոնք կկարողանան դինամիկայում ե րաշխավորել դատական իշխանության անկախությունը` անհրաժեշտ հակակշիռների, զսպումների մեխանիզմի միջոցով»,- նշեց Հարությունյանը:

Նախագծում ամրագրված դրույթներով կմեծանա նաև Սահմանադրական դատարանի դերակատարությունը: Սահմանադրական դատարանն այլևս իրավասու է լինելու քննել դատարանի և իշխանության այլ մարմինների միջև լիազորությունների հարցով ծագած վեճերը: Հստակեցվել են դատարանների կողմից Սահմանադրական դատարան դիմելու լիազորությունները և պարտականությունները:

Մյուս փոփոխությունն այն է, որ որևէ իրավական նորմի սահմանդրականության վերաբերյալ հիմնարար կասկած ունենալու դեպքում դատարանները հնարավորություն կունենան դիմել սահմանադրական դատարան, և նրանց միջնորդությունը քննության կառնվի կոնկրետ այդ գործի քննության համար: «Սա որակապես նոր վիճակ է: Սահմանադրական դատարանն անհատական դիմումները քննելիս ոչ միայն գնահատելու է նորմի սահմանադրականությունը, այլև իրավակիրառման պրակտիկայում դրան տված մեկնաբանությունը, որը նույնպես չափազանց կարևոր է»,- ընդգծեց ՍԴ նախագահը` հավելելով, որ Սա հմանադրական դատարանի քննության առարկա են դառնալու նաև բոլոր տեսակի իրավական ակտերը:
