Ապօրինի ռազմամթերք պահելու վերաբերյալ քրեական գործն ընդունվել է ՀՔԾ վարույթ

ՀՀ ոստիկանության Աշտարակի բաժնի համայնքային ոստիկանության բաժանմունքի ծառայող Կ. Հ.-ի զեկուցագրի ուսումնասիրությամբ պազվել է, որ ինքը 2016թ. հունվարի 18-ին ոստիկանության հիշյալ ստորաբաժանման աշխատակիցների հետ այցելել է Աշտարակ քաղաքի բնակիչ Սարգիս Մ.-ի տուն՝ վերջինիս պատկանող «Սայգա ՄԿ» տեսակի հրազենի պահման պայմանները ստուգելու նպատակով: Ինչպես տեղեկացրին ՀՔԾ լրատվական ծառայությու նից, ստուգմամբ մետաղյա պահարանից հայտնաբերվել է 6 հատ փամփուշտ, ինչպես նաև 1 հատ 16մմ տրամաչափի որսորդական հրացան՝ առանց փաստաթղթերի:  

Սարգիս Մ.-ն այդ կապակցությամբ հայտնել է, որ ինքը հայտնաբերված փամփուշտները ձեռք է բերել որսորդական խանութից, իսկ հրացանը պատկանել է հանգուցյալ հորը:

Դեպքի առթիվ ոստիկանության Աշտարակի բաժնում նախապատրաստվել են նյութեր, որի ընթացքում Սարգիս Մ.-ի մոտից վերցված հրացանն ու 6 փամփուշտները ուղարկվել են փորձաքննության: Փորձագետի եզրակացության համաձայն` հրացանը հանդիսանում է որսորդական ողորկափող հրազեն, իսկ 6 փամփուշտները մարտական են և հանդիսանում են ռազմամթերք: 

Ոստիկանության հիշյալ բաժնի ավագ հետաքննիչի կողմից որոշում է կայացվել նախապատրաստված նյութերով քրեական գործ հարուցելը մերժելու մասին` Սարգիս Մ.-ի արարքում հանցակազմի բացակայության հիմքով: Որոշման օրինականությունը ստուգող դատախազը վերացրել է նյութերով քրեական գործ հարուցելը մերժելու մասին ավագ հետաքննիչի որոշումը և ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցել է քրեական գործ ու նախաքննություն կատարելու համար ուղարկել ՀՀ քննչական կոմիտեի Արագածոտնի մարզային քննչական վարչության Թալինի քննչա կան բաժին:

Հետագայում ՀՀ գլխավոր դատախազը գործի փաստական հանգամանքներով պայմանավորված՝ լրիվ, օբյեկտիվ և բազմակողմանի քննությունը երաշխավորելու անհրաժեշտությունից ելնելով՝ քրեական գործը քննության է ուղարկել ՀՀ հատուկ քննչական ծառայություն:
