Մարդու իրավունքների պաշտպանի հայտարարությունը Վարդգես Գասպարիի գործի վերաբերյալ

ՀՀ Ազգային ժողովում Մարդու իրավունքների պաշտպանի ընտրության գործընթացի շրջանակներում մի շարք պատգամավորների կողմից բարձրաձայնվել է քաղաքացիական ակտիվիստ Վարդգես Գասպարիին ազատությունից զրկելու իրավաչափության հարցը: Միևնույն ժամանակ‚ այսօր՝ փետրվարի 24-ին Վ.Գասպարիի փաստաբանը Մարդու իրավունքների պաշտպանի աշխատակազմ ահազանգ է ներկայացրել այն մասին‚ որ Վարդգես Գասպարին ՀՀ Արդարադատության նախարարության «Նուբարաշեն» քրեակատարողական հիմնարկում ենթարկվել է խոշտանգման: Բացի այդ‚ Վարդգես Գասպարիի կինը և փաստաբանը ահազանգել են Վ.Գասպարիի կնոջ հետ նրա տեսակցություն չթույլատրելու մասին:

Ահազանգի հիման վրա ՀՀ Մարդու իրավունքների պաշտպանի աշխատակազմի արագ արձագանքման ծառայության աշխատակիցներն այցելել և տեսակցել են Վ.Գասպարիին:

Վարդգես Գասպարին հայտնել է‚ որ սկսել է հացադուլ‚ քանի որ խցում ենթարկվել է վատ վերաբերմունքի‚ այդ թվում՝ բռնության: Վ.Գասպարին հայտնել է նաև‚ որ իրեն տեղափոխել են այլ խուց: Մարդու իրավունքների պաշտպանի ներկայացուցիչների հետ հանդիպումից հետո Վարդգես Գասպարին դադարեցրել է հացադուլը:

Վերը շարադրվածի հիման վրա Մարդու իրավունքների պաշտպանը սեփական նախաձեռնությամբ սկսել է հարցի քննարկման ընթացակարգ և դիմել է ՀՀ գլխավոր դատախազին Վարդգես Գասպարիի հայտնած տվյալների հիման վրա ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով վարույթ նախաձեռնելու առաջարկով:

Նույն հարցի վերաբերյալ պարզաբանումներ ստանալու նպատակով Մարդու իրավունքների պաշտպանը դիմել է նաև ՀՀ արդարադատության նախարարին:

Վարդգես Գասպարիի կինը‚ ինչպես նաև նրա փաստաբանը Մարդու իրավունքների պաշտպանին ահազանգ են ներկայացրել նաև այն մասին‚ որ Վ.Գասպարիի կնոջը «Նուբարաշեն» քրեակատարողական հիմնարկի ծառայողները երկու անգամ թույլ չեն տվել տեսակցել Վ.Գասպարիի հետ: Այս հարցի կապակցությամբ նույնպես պարզաբանումներ են պահանջվել ՀՀ արդարադատության նախարարից:

Ինչ վերաբերում է Վ.Գասպարիին ազատությունից զրկելու իրավաչափության հարցին‚ ապա ուսումնասիրությամբ պարզվել է‚ որ Վարդգես Գասպարիին կալանավորելու մասին որոշում իր վարույթում գտնվող քրեական գործով կայացրել է դատարանը: «Մարդու իրավունքների պաշտպանի մասին» ՀՀ օրենքի 7-րդ հոդվածի համաձայն՝ «Պաշտպանն իրավասու չէ միջամտել դատական վարույթին»: Նույն օրենքի 12-րդ հոդվածի 1-ին մասի 3-րդ կետը Մարդու իրավունքների պաշտպանին արգելում է բողոքի ուսումնասիրման ընթացքում առաջացած հարցերի վերաբերյալ պարզաբանումներ ստանալ դատավորներից:

Այդուհանդերձ‚ հաշվի առնելով Մարդու իրավունքների պաշտպանի ընտրության գործընթացի շրջանակներում նշված հարցը բարձրացվել է ՀՀ Ազգային ժողովի մի շարք պատգամավորների կողմից՝ Մարդու իրավունքների պաշտպանի կողմից Վ.Գասպարիի փաստաբանների հրապարակային հայտարարությունների հիման վրա ուսումնասիրել է նաև Վարդգես Գասպարիին ազատությունից զրկելու հետ կապված իրավական հարցը:

Ուսումնասիրության հիման վրա Մարդու իրավունքների պաշտպանն արձանագրում է‚ որ անձին ազատությունից զրկելու հարցը լուծելիս ՀՀ Սահմանադրությամբ և Հայաստանի Հանրապետության կողմից վավերացված միջազգային պայմանագրերի դրույթները պահանջում են պահպանել դրանցով սահմանված չափանիշները մասնավորապես՝ ազատությունից զրկման հարցը լուծելիս դատարանի կողմից լսվելու իրավունքը‚ ազատությունից զրկվելու պատճառների մասին տեղեկանալու իրավունքը և այլն:

Մարդու իրավունքների պաշտպանը լիահույս է‚ որ իրավասու մարմինների կողմից հաշվի կառնվեն նշված չափանիշները Վարդգես Գասպարիի անազատության մեջ պահելու իրավաչափության հարցը քննարկելիս:
