ՄԻԵԴ-ը Հայաստանին պարտավորեցրել է 3600 եվրո փոխհատուցում վճարել քաղաքացի Դոմազյանին

Մարդու իրավունքների եվրոպական դատարանը փետրվարի 25-ին որոշում է կայացրել «Դոմազյանն` ընդդեմ Հայաստանի» գործով` ՀՀ կառավարությանը պարտավորեցնելով 3600 եվրո փոխհատուցում վճարել:

Հայաստանի քաղաքացի Թամարա Դոմազյանը, որն այժմ բնակվում է Սանկտ Պետերբուրգում, 2007 թ. մայիսին ընդդեմ Հայաստանի Հանրապետության հայց է ներկայացրել ՄԻԵԴ՝ բողոքելով, որ զրկվել է դ ատարան դիմելու իրավունքից, քանի որ Հայաստանի դատարանը մերժել է ընդունել քաղաքացիական գործով իր ներկայացուցչի կողմից ներկայացված հակընդդեմ հայցը։

Ըստ գործի նյութերի՝ 2005 թ. սեպտեմբերին Թամարա Դոմազյանն ստացել է Երևանում իրեն պատկանող, սակայն ապօրինի կառուցված ավտոտնակի և օժանդակ շինության նկատմամբ սեփականության վկայական՝ հիմնված 2005թ․-ի հուլիսի 22-ին Երևանի քաղաքապետի ընդունած որոշման վրա, որով ճանաչվում էր Թամարա Դոմազյանի սեփականության իրավունքը։ Սակայն  2006թ․ հունիսին քաղաքապետն ընդունել է մեկ այլ որոշում, որով չեղյալ է համարել Թամարա Դոմազյանի սեփականության իրավունքը։ Մեկ ամիս անց քաղաքապետը հայց է ներկայացրել դատարան՝ անվավեր ճանաչելու դիմումատուի սեփականության վկայականը, որը բավարարվել է: Վերջինս լիազորել է իր փաստաբանին՝ ներկայացնելու քաղաքապետի 2006 թ. հունիսի որոշումը անվավեր համարելու հակընդդեմ հայց:

2006թ․-ի նոյեմբերի 1-ին առաջին ատյանի դատարանի որոշմամբ չի ընդունվել Թամարա Դոմազյանի լիազոր ներկայացուցչի ներկայացրած հակընդդեմ հայցը: Այնուհետև քաղաքապետի ներկայացրած հայցի բավարարման դեմ փաստաբանը գանգատ է ներկայացրել Վերաքննիչ դա տարանում, որն այն թողել է առանց քննության՝ նշելով, որ ընդհանուր իրավասության առաջին ատյանի դատարանի բողոքարկումը չի կատարվել պատշաճ ժամկետներում։ Թամարա Դոմազյանի ներկայացուցչի բողոքը մերժվել է նաև Վճռաբեկ դատարանի կողմից 2007թ․ փետրվարին։

Հենվելով Մարդու իրավունքների եվրոպական կոնվենցիայի 6-րդ հոդվածի առաջին կետի վրա (արդար դատաքննության իրավունք)՝ Թամարա Դոմազյանը ընդդեմ Հայաստանի հայց է ներկայացրել ՄԻԵԴ՝ նշելով, որ առաջին ատյանի դատարանի կողմից իր հակընդդեմ հայցի մերժման արդյունքում խախտվել է դատարանի հասանելիության իր իրավունքը:

Եվրոպական դատարանն իր վճռում գտել է, որ խախտվել է դիմումատուի՝ դատարանի հասանելիության իրավունքը, և տեղի է ունեցել Կոնվենցիայի 6-րդ հոդվածի 1-ին կետի խախտում, միևնույն ժամանակ մերժել է դիմումատուի կողմից արդար դատաքննության խախտման հետ կապված մնացած պահանջները: Դատարանը պարտավորեցրել է Հայաստանին, որպես ոչ նյութական վնասի արդարացի փոխհատուցում, Թամարա Դոմազյանին վճարել 3600 եվրո։
