Հայաստանի երրորդ հանրապետության 23 ամյա անկախություն,շնորհավորանքներ, պետական պարգևներ, աշխարհի բազմաթիվ երկրներից շնորհավորանքններ ուղղված հայ ժողովրդին, շքեղ տոնախմբություն Հանրապետության հրապարակում, տոնական միջոցառումներ մայրաքաղաքի և հանրապետության տարբեր ծայրերում և հպարտություն, որ 23 տարի առաջ հայ ժողովուրդն «այո» է ասել անկախությանը, սակայն այո ասողներից ոմանք դատապարտված են հայրենիքի անկախությունը միշտ ճաղերի ետևից «տեսնելու»: Նշանավոր մարդկանց, պաշտոնյաների, ղեկավարների շնորհավորանքներում նրանց մասին չեն նշում, նրանց չեն հիշում ու շնորհավորում, բայց չէ որ նրանց մեջ կարող են ամենաանմեղսունակ ու հայրենիքին նվիրված քաղաքացիներ լինեն: Անկախ Հայաստանի հանրապետությունում կա 104 ցմահ ազատազրկված: 2,5 միլիոն բնակչություն ունեցող Հայաստանի համար 104 ցմահ ազատազրկման դատապարտվածը հսկայական մեծ թիվ է կազմում: Եթե համեմատնենք Ֆրանսիայի հետ, որի բնակչությունը անցնում է 64 միլիոնը վերջի երկու տարվա տվյալներով ցմահ ազատազրկման դատապարտվածների թիվը հասնում է 550-ի, իսկ 38 մլն բնակչություն ունեցող Լեհաստանն ունի 200 ցմահ դատապարտյալ: Հայաստանում նման ցուցանիշը կարող է մեկ բան վկայել` անարդար է արդարադատության համակարգը: Հայաստանում դատական սխալի մասին խոսելը երբևէ իրավական ընթացք չի ստանում: Առհասարակ հայկական իրականությունն այդպիսի է` մարդիկ էլ իրենց սխալները չեն ընդունում: Ժողովրդավար երկրներում ցմահ դատապարտյալների պատժի փոփոխության, դատական սխալի և նույն ցմահ դատապարտյալին ազատ արձակելու դեպքեր ոչ հաճախ, սակայն գրանցվում են: Ամերիկացի Քելվին Ջոնսոննը 1983-ին մեղադրվել էր բռնաբարության և սպանության մեջ և դատապարտվել ցմահ ազատազրկման: Ազատազրկման 16 տարիների ընթացքում Քելվինը պայքարել է իր անմեղությունն ապացուցելու համար և 16 տարի անց նրան հաջողվել է փոխել իր ճակատագիրը` նրան ազատ են արձագել: Ճապոնիայում 1966-ին ցմահ ազատազրկման դատապարտված Հակամադան աշխարհում ամենաերկարն է մնացել մահապարտների խցում: Նրան դատապարտել էին մի քանի սպանության մեղադրանքով, սակայն 47 տարի անց դատարանը որոշել է վերանայել գործն ու նրան անմեղ է ճանաչել: Հայաստանում նման աղմկահարույց մեկ դեպք է գրանցվել, երբ մոտ տասը տարի պայքարից հետո Մատաղիսի գործով երեք զինվորներ արդարացվեցին: Հայաստանում ցմահ ազատազրկման դատապարտվում է 18 տարին լրացած անձը: 104 ցմահ դատապարտյալներից 15-ը դատապարտվել են զինվորական ծառայության ժամանակ` 18-20 տարեկանում: Այստեղ էլ տարբերվում ենք աշխարհից: Ժողովրդավար երկրներում եթե անձի տարիքը հանցանք կատարելու պահին 21-ը լրացած չի եղել, 10 տարի անց կարող է դիմել պայմանական վաղաժամկետ ազատ արձակման համար, իսկ եթե անձի տարիքը 21-ն անց է վաղաժամկետ ազատ արձակման համար կարող է դիմել 20 տարի անց: Ինչ է մնում անել` բարձրաձայն գոռալ` շնորհավոր անկախությունդ հայրենի՛ ք, գոռալ, որպեսզի ձայնդ թափանցի անազատության ճաղերից ներս: Շնորհավոր հայրենիքիդ անկախությունը ցմա՛ հ դատապարտյալ, եթե, իհարկե, նրանք գիտեն, որ ամսաթիվը սեպտեմբերի 21-ն է, հնարավոր է չիմանան, չէ որ նրանք ոչ մի օրվա ու ոչ մի ժամկետի ավարտի չեն սպասում...Անկախություն` այն անհարժեշտ է նաև դատական համակարգին, այն կարող է ճակատագրեր փրկել կենդանի գերեզմանոցից: Անկախությունը նրանցը չէ: Բեթղեհեմ Արաբյան
