ՀՀ կառավարությունը բացասական եզրակացություն տվեց ԱԺ պատգամավոր Հրանտ Բագրատյանի օրենսդրական նախաձեռնության կարգով ներկայացրած «ՀՀ քաղաքացիական օրենսգրքում փոփոխություն կատարելու մասին» ՀՀ օրենքի նախագծին: ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը նշեց, որ օրինագծով առաջարկվում է փոփոխություն կատարել օրենսգրքի` գրավին վերաբերող կարգավորումներում:

Մասնավորապես, առաջարկվում է օրենսգրքի 230-րդ հոդվածի 1-ին մասը շարադրել նոր խմբագրությամբ` փոփոխելով օրենքով թույլատրելի գրավի առարկա հանդիսացող գույքի շրջանակը, որոնք չեն կարող լինել գրավի առարկա: Այսպես, առաջարկվում է բացառությունների մեջ նախատեսել սեփականատիրոջ անչափահաս երեխայի(ների) սեփականության կամ օգտագործման իրավունքով ծանրաբեռնված բնակարանը, բացառություններից հանել պետական (գանձապետական) անվանական այն արժեթղթերը, որոնց թողարկման պայմաններով նախատեսված են, որ այդ արժեթղթերը գրավադրման ենթակա չեն: Ըստ հիմնավորման՝ նախագ ծի նպատակն է կանխարգելել այն դեպքերը, երբ գրավատու հանդիսացող ծնողի կողմից իր պարտավորությունները չկատարելու կամ ոչ պատշաճ կատարելու արդյունքում անչափահաս երեխաները զրկվեն գրավի առարկա բնակելի տարածությունից` մնալով անօթևան:

Արփինե Հովհաննիսյանը նշեց, որ պատգամավորն իրավացիորեն վեր է հանել այնպիսի խնդիրներ, որոնք գոյություն ունեն մեր պրակտիկայում: «Միանգամայն հասկանալով պատգամավորի մտահոգությունը և կիսելով խնդրո առարկա հանդիսացող հարցը, դրա վերաբերյալ նրա առաջարկած տեսակետները՝ այդուհանդերձ, համարում ենք, որ այսպիսի՝ նման կոշտ կարգավորում նախատեսելն ուղղակիորեն հակասության մեջ է մտնում սեփականության իրավունքի և Սահմանադրությամբ նախատեսված սեփականատիրոջը պատկանող երեք իրավազորությունների հետ՝ տիրապետում, տնօրինում և օգտագործում»,- Արմենպրեսի փոխանցմամբ՝ նշեց նախարարը՝ հավելելով, որ անհրաժեշտ է փոփոխություններ անել ոչ թե ՀՀ քաղաքացիական օրենսգրքում, այլ ՀՀ ընտանեկան օրենսգրքում:

Հովհաննիսյանը տեղեկացրեց, որ այդպիսի օրինագիծ արդեն դրվել է շրջանառության մեջ: «Մենք առաջարկում ենք պատգամավորին համապատասխան փոփոխությունը ձևակերպել Ընտանեկան օրենսգրքում և այդ պարագայում մենք ինքներս էլ հայտնում ենք մեր աջակցությունը և պատրաստակամությունը ցանկացած օգնություն ցուցաբերելու»,- ասաց նախարարը:

ՀՀ վարչապետ Հովիկ Աբրահամյանն է առաջարկեց Արփինե Հովհաննիսյան աշխատել Հրանտ Բագրատյանի հետ՝  ընդհանուր տեսակետի հանգելու համար:
