«Պրոբացիայի մասին» «Պրոբացիայի պետական ծառայության մասին» և հարակից օրենքներում փոփոխություններ և լրացումներ կատարելու մասին ՀՀ օրենքների նախագծերի վերաբերյալ ապրիլի 15-ին տեղի է ունեցել հանրային քննարկում: Ինչպես տեղեկանում ենք ՀՀ ԱՆ տեղեկատվության և հասարակայնության հետ կապերի վարչությունից, միջոցառմանը մասնակցել են ՀՀ արդարադատության նախարարի տեղակալ Սուրեն Քրմոյա նը, պետական, միջազգային և հասարակական կազմակերպությունների այլ ներկայացուցիչներ:

Սուրեն Քրմոյանը հանրային քննարկման մասնակիցներին տեղեկացրել է, որ 2016 թվականի ապրիլի 7-ին օրենսդրական փաթեթն առաջին ընթերցմամբ ընդունվել է Ազգային Ժողովի կողմից:

Նրա խոսքով՝ ներկայացված օրենսդրական փաթեթը կարգավորում է պրոբացիայի նպատակները, խնդիրները, այլընտրանքային խափանման միջոցների, ազատությունից զրկելու հետ չկապված պատիժների, պատիժը պայմանականորեն չկիրառելու, պատժիցպայմանական վաղաժամկետ ազատման դեպքում փորձաշրջան նշանակելու առանձնահատկությունները: Ըստ նախարարի տեղակալի՝ պրոբացիայի ծառայության ներդրման, քրեական և քրեական դատավարության նոր օրենսգրքերի կիրառման դեպքում քրեական արդարադատությունն ու քրեական պատիժների համակարգը փոփոխության կենթարկվեն և կդառնան մարդակենտրոն, կու ղղվեն մարդու իրավունքներին:

«Արդյունքում կներդրվի քրեական վերականգնողական արդարադատության համակարգ, որը նշանակում է՝ պատժի նպատակներին հնարավոր կլինի հասնել ոչ միայն անձին զրկելով ազատությունից, այլև նրա հետ կատարելով որոշակի վերասոցիալականացման, վերաինտեգրման աշխատանքներ»,- ասել է Սուրեն Քրմոյանը՝ ընդգծելով, որ պրոբացիայի ներդրման համար հիմք է հանդիսանում Իրավական և դատական բարեփոխումների 2012-2016 թվականների ռազմավարական ծրագիրը և դրանից բխող միջոցառումների ցանկը հաստատելու մասին ՀՀ նախագահի կարգադրությունը:

Քննարկման ավարտին տեղի է ունեցել մտքերի փոխանակում: Հիշեցնենք, որ երկու տարի առաջ Նորվեգիայի կառավարության ֆինանսավորմամբ մեկնարկած ԵԽ «Աջակցություն Հայաստանումպրոբացիայի ծառայության ստեղծմանը» ծրագրի շրջանակում իրականացվել են վերապատրաստման ծրագրեր այլընտրանքայինպատիժների բաժինների աշխատակիցների, իրավաբանների, դատավորների և դատախազների, կամավորների և ՀԿ-ների համար, ներդրվելէ նաև պիլոտային պրոբացիոն ծառայության երկո ստորաբաժանում Երևանում և Վանաձորում:
