Այն, որ Հայաստանում հարկային մարմիններն աշխատում են գրեթե «իդեալական», դեռ մի բան էլ ավելի, նորություն չէ: Բացահայտում չի լինի ասել նաեւ, որ աշխատում են ըստ պահի շահավետության ու սեփական դրդապատճառներով: Թեպետ պատկան մարմինների ներկայացուցիչներն ու բարձրաստիճան պաշտոնյաները, օգտագործելով հնարավոր բոլոր հարթակները, դե ֆակտո բարձրաձայնում են փոքր ու միջին բիզնեսի խթանման մասին, սակայն դե յուրե գործարարները բախվում են արհեստական արգելքների:

Մասնակցելով գնումների գործընթացի բողոքների վերաբերյալ գնումների աջակցման կենտրոնի նիստերին՝ արձանագրեցինք հետաքրքիր մի փաստ, որ հարկային տեսչության (հավանաբար միտումնավոր) սխալ տեղեկանք տրամադրելու պատճառով «Տրանս-սֆեր» ՍՊԸ-ն զրկվում է գնումների մասնակցության իրավունքից, որը բողոք էր ներկայացրել առ այն, որը 2016 թվականի մարտի 21-ին մասնակցել է հերթական մրցույթին ու ճանաչվել հաղթող: Սակայն, գնումների ընթացակարգի պահանջի համաձայն, հարկային տեսչությունը տեղեկություն է տվել, որ տվյալ կազմակերպությունը ունի ժամկետանց պարտավորություն: Զավեշտալին այն է, որ «Տրանս-Սֆեր» ՍՊԸ-ն մրցույթին մասնակցելու օրվա դրությամբ փաստացի չի ունեցել ժամկետանց հարկային պարտավորություններ, որի համար էլ բողոքարկել էր գործընթացը:

Տեղեկացնենք, որ ընկերության տնօրինությունը հարցում է ուղարկել ՀՀ ՊԵԿ Մաշտոցի հարկային տեսչություն՝ տրամադրելու տեղեկանք հարկային պարտավորությունների վերաբերյալ: Վերջինս, իր հերթին, ստանալով հստակ հարցադրումներ, որպես պատասխան տրամադրել է տեղեկանք, որ մրցույթի անցկացման օրը «Տրանս-Սֆեր» ՍՊԸ-ն չի ունեցել ժամկետանց պարտավորություններ, իսկ մեկ այլ տեղեկանքով պնդել է, որ տվյալ կազմակերպությունն ունեցել է ժամկետանց պարտավորություններ:

Նշենք, որ գնումների աջակցման կենտրոնի բողոքարկման հանձնաժողովի անդամները զարմացած էին ՀՀ ՊԵԿ Մաշտոցի հարկային տեսչության պետ Հ. Կարապետյանի կողմից տրված հակասական տեղեկանքներից: Սակայն, իրավասու մարմնի կողմից տրված տեղեկանքը ընդունելով ի գիտություն, նշված հանձնաժողովը որոշում է կայացրել բողոքը մերժել: Փաստացի ստացվում է այնպես, որ հարկային մարմինների կողմից տրամադրված սխալ կամ անարժանահավատ տեղեկությունները հանգեցնում են կազմակերպությունների՝ գնումների գործընթացին չմասնակցելուն եւ «սեւ ցուցակում» հայտնվելուն, ինչը նպաստում է վերջիններիս կազմալուծմանը:

Այստեղից հարց է առաջանում, թե ինչով է պայմանավորված կարեւորագույն պետական մարմին հանդիսացող ՀՀ ՊԵԿ Մաշտոցի հարկային տեսչության կողմից տրվող սխալ տեղեկանքների տրամադրումը՝ մասնագիտական կամ կրթական թերացմա՞մբ, թե՞ անձնական դրդապատճառներով:
