Ավետիսյանների իրավահաջորդները գանգատ են ներկայացրել ՄԻԵԴ՝ ընդդեմ ՌԴ-ի

Ավետիսյանների ընտանիքի սպանության գործով տուժող Արաքսյա Պողոսյանի իրավահաջորդներ Անդրանիկ և Նարինե Պողոսյանների կողմից ՀՔԱ Վանաձորի գրասենյակի աջակցությամբ Ռուսաստանի Դաշնության դեմ գանգատ է ներկայացվել Մարդու իրավունքների եվրոպական դատարան՝ Մարդու իրավունքների եվրոպական կոնվենցիայի 2-րդ (Կյանքի իրավունք) և 13-րդ (Իրավական պաշտպանության արդյունավետ միջոցի իրավունք) հոդվածներով նախատեսված իրավունքների խախտման հիմքով: Գանգատը հիմնավորվել է նրանով, որ ՄԻԵԿ 2-րդ հոդվածի իմաստով թույլ են տրվել նյութական և դատավարական իրավունքի խախտումներ:

Մասնավորապես՝ պետությունը չի կանխարգելել Արաքսյա Պողոսյանի և նրա ընտանիքի անդամների կյանքի նկատմամբ ակնհայտ վտանգը կանխարգելելու իր պարտավորությունը՝ հստակ իմանալով, որ Վալերի Պերմյակովը ենթակա չէ զորակոչման, առավել ևս՝ իրավունք չունի զենքով ծառայություն իրականացնելու: Բացի դրանից՝ ռուսական կողմը պատշաճ կարգով և ժամանակին չի տեղեկացրել հայ իրավապահներին Վ. Պերմյակովի՝ զորամասը լքելու մասին, ինչը կարող էր կանխել ողբերգությունը:

Ինչ վերաբերում է դատավարական իրավունքի խախտմանը, ապա ռուսական կողմի իրականացրած քննությունը հասանելի չի եղել տուժողի իրավահաջորդներին, ինչի արդյունքում վերջիններս զրկվել են գործի շրջանակներում իրենց իրավունքներն իրացնելու հնարավորությունից, մասնավորապես՝ միջնորդություններ ներկայացնելու, նախաքննական մարմնի որոշումները բողոքարկելու և այլ հնարավորություններից:

Ինչպես նաև՝ Վ. Պերմյակովի կողմից զորամասը ինքնակամ լքելու մասին ՀՀ իրավապահ մամիններին շուրջ երեք ժամ ուշ տեղեկացնելու մասով որևէ պաշտոնատար անձ պատասխանատվության չի ենթարկվել:

ՄԻԵԿ 13-րդ հոդվածի իմաստով տուժողի իրավահաջորդների իրավունքների վերականգնման ուղղությամբ ներպետական մեխանիզմներ չկան, քանի որ ռուսական կողմի իրականացրած քննության նյութերին տուժող կողմը հնարավորություն է ունեցել ծանոթանալու վերջնական որոշման կայացման պահից շուրջ երեք ամիս անց միայն, երբ արդեն ՌԴ Քննչական կոմիտեում ավարտվել էին Ավետիսյանների ընտանիքի սպանության գործով բոլոր վարույթները, և Վ. Պերմյակովը դատապարտվել էր տասը տարվա ազատազրկման:
