Փաստաբանները քաղաքական նշանակություն ունեցող դատավարությունների ոլորտի փորձ են փոխանակել

Հայաստանի Հանրապետության փաստաբանների պալատում օգոստոսի 30-ին տեղի է ունեցել  «Քաղաքական նշանակություն ունեցող դատավարությունների ժամանակ փաստաբանի դերը» թեմայով քննարկում: Քննարկման բանախոսը Փարիզի փաստաբանների միության անդամ, փաստաբան Սևակ Թորոսյանն էր:

Այս մասին տեղեկացրին ՀՀ ՓՊ մամուլի ծառայությունից՝ հավելելով. «Քննարկման սկզբում բանախոսն անդրադարձել է միջազգային դատավարական պրակտիկայում ընդունված «հիմնադիր դատավարություն»  հասկացության սահմանմանը: Նրա ներկայացմամբ՝ այդ դատավարությունները հիմնականում ազդեցություն են թողնում ժողովրդավարության սկզբունքի  վրա, և երևում է, որ փաստաբանի դերն իրականացել է: Նա նշել է, որ, ինչքանով տեղյակ է իր հայաստանյան գործընկերներից, մեր երկրում նման դատավարություններ դեռ չեն եղել: 

Այս իմաստով նա առանձնացրել է ազատ երկրի պայմանական 4 սյուն՝ օրենք, մամուլի ազատություն, քաղաքացիական շարժումների ազատություն և փաստաբան: Նա նշել է, որ փաստաբանի իրական դերի գիտակցումը կարևոր ներդրում է երկրի ընդհանուր ժողովրդավարության զարգացման հարցում:

Փորձի փոխանակման վերածված քննարկմանը փաստաբաններն անդրադարձել են քաղաքական բնույթի դատավարություններում փաստաբանի դերին, մշակած մարտավարության առանձնահատկություններին, ինչպես նաև՝ գործի շրջանակներում փաստաբանական գաղտնիքի պահպանման ըմդհանուր օրինաչափություններին:

Գործընկերների խնդրանքով Սևակ Թորոսյանն անդրադարձել է իր պրակտիկայում հանդիպած փաստաբանի անձին սպառնացող վտանգի և դրա չեզոքացման երաշխիքների բացակայության պայմաններում ստանձնած պաշտպանությունից չհրաժարվելու, ինչպես նաև թույլատրելիության սահմաններում տվյալ գործին հասարակական հնչեղություն հաղորդելու օրինակներին: Այս համատեքստում կարևորելով մամուլի հետ աշխատելու անհրաժեշտությունը՝ հայաստանցի փաստաբանները նույնպես իրենց գործունեությունից օրինակներ են ներկայացրել:

Բանախոսն, անդրադառնալով փաստաբանի առաքելությանը, նշել է, որ կարևոր է այն գիտակցումը, որ պաշտպանյալից զատ պաշտպանել է պետք հանրային ազատությունը: Նրա կարծիքով՝ այս կերպ է միայն հնարավոր քաղաքական բնույթի դատավարությունների ժամանակ հասնել հատկանշական արդյունքի՝ ի սկզբանե պահպանելով քաղաքական չեզոքություն և պահանջվող լռություն:

Քննարկելով արդարադատության հասնելու ներպետական ատյանների սպառումն ու Մարդու իրավունքների եվրոպական դատարան դիմելու որոշ դեպքեր՝ փաստաբաններն անդրադարձել են մեր օրենսդրության բացերին՝ կարևորելով ոչ միայն փաստաբանի, նաև դատավորի դերը յուրաքանչյուր դեպքով արդար դատավճիռ ունենալու հարցում: Համակարծիք լինելով գործընկերների հետ՝ Սևակ Թորոսյանը նշել է, որ Ֆրանսիայից դուրս իրականացրած իր գործունեությունից եզրահանգել է, որ արդար հանգուցալուծման համար փաստաբանից առավել համարձակ պետք է լինի դատավորը:

Գործընկերները քննարկել են «Սասնա Ծռեր» խմբի անդամներին առնչվող պաշտպանական որոշ հարցեր, այդ թվում նաև՝ նրանց պաշտպանների կողմից բարձրաձայնվող հարցերի շուրջ առաջացող հասարակական և որոշ գերատեսչությունների արձագանքները»:
