ՍԴ-ն սահմանադրական է ճանաչել Պավել Մանուկյանի և Վարուժան Ավետիսյանի կողմից վիճարկվող հոդվածները

 Սահմանադրական դատարանը հրապարակեց ՀՀ ոստիկանության պարեկապահակային գնդի տարածքը գրաված զինված խմբավորման անդամներ Պավել Մանուկյանի և Վարուժան Ավետիսյանի դիմումների հիման վրա ՀՀ Քրեական դատավարության օրենսգրքի երկու հոդվածների՝ 283-րդ հոդվածի 1-ին մասի, 288-րդ հոդվածի 3-րդ մասի` Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործով որոշումը:

Ինչպես հաղորդում է «Արմենպրես»-ը, ՍԴ-ն որոշեց, որ վիճարկվող հոդվածները` ՀՀ Քրեական դատավարության օրենսգրքի 283-րդ հոդվածի 1-ին մասը, 288-րդ հոդվածի 3-րդ մասը, համապատասխանում են ՀՀ Սահմանադրությանը:

«Ելնելով գործի քննության արդյունքներից եւ ղեկավարվելով  ՀՀ Սահմանադրության 100-րդ հոդվածի առաջին կետով, 101 հոդվածի առաջին մասի 6 կետով,  102 հոդվածով, Սահմանադրական դատարանի մասին ՀՀ օրենքի 63, 64, 69-րդ հոդվածներով` որոշեց. ՀՀ Քրեական դատավարության օրենսգրքի 283-րդ հոդվածի 1-ին մասը համապատասխանում է ՀՀ սահմանադրությանը, 288-րդ հոդվածի 3-րդ մասը համապատասխանում է ՀՀ սահմանադրությանը սույն որոշման մեջ Սահմանադրական դատարանի արտահայտած իրավական դիրքորոշումների շրջանակներում»,- ասված է Բարձր դատարանի որոշման մեջ:

Պավել Մանուկյանն ու Վարուժան Ավետիսյանը ՍԴ էին դիմել դեռեւս այս տարվա մարտին:

Նրանք խնդրել էին դատարանին անվավեր ճանաչել այդ հոդվածները: Ըստ դիմողների՝ օրենսգրքի 283-րդ հոդվածի 1-ին մասով նախատեսվածպահանջը՝ կապված անձի կալանավորմանն առնչվող դատական լսումները դռնփակ դատական նիստում անցկացնելու հետ, չի բխումՍահմանադրության 63-րդ հոդվածի 1-ին և 2-րդ մասերից և ուղղակիորեն հակասում է վերջիններիս: Միեւնույն ժամանակ, Մանուկյանն ուԱվետիսյանը կարծում են, որ Քրեական դատավարության 288-րդ հոդվածի 3-րդ մասի` «Դատական ստուգումը կատարվում է դռնփակ դատականնիստում` դատախազի և պաշտպանի մասնակցությամբ» իրավադրույթը հակասում է Սահմանադրության 63-րդ հոդվածի 1-ին և 2-րդ մասերին:
