 Ամեն կերպ պետք է շեշտենք, որ 2007 թվականի մարտի 9-ին Լոզանի դատարանի կողմից Դողու Փերինչեքի գործով կայացված վճիռն իր ուժն ունի:

«Արմենպրես»-ի հետ զրույցում նման տեսակետ հայտնեց Հայաստան-Շվեյցարիա խորհրդարանական պատգամավորական խմբի գլխավոր քարտուղար Սարգիս Շահինյանը:

Սեպտեմբերի 9-ին հայտնի էր դարձել, որՇվեյցարիայի ֆեդերալ տրիբունալը չեղյալ էհամարել թուրք ազգայնական Դողու Փերինչեքիդեմ ռասսայական խտրականությունպարունակող արտահայտությունների համարկայացված վճիռը: Այս մասին որոշումըդաշնային տրիբունալն ուղարկել է որոշումըկայացրած Վո (Vaud) կանտÕ �նի (կենտրոնը`Լոզան) դատարան:

«Ամեն ինչ կախված է նրանից, թե արդյոք դատարանը կթողնի, որ Շվեյցարիա-Հայաստան ընկերակցությունն իր դիրքորոշումը հայտնի այս առումով, եւ արդյոք պատրաստ է ընդունելու լրացուցիչ տեղեկություններ, որոնք պետք է փորձենք տրամադրել դատարանին: Մինչեւ այս կետերը հստակ չլինեն, մեր կարողությունները, թերեւս, սահմանափակ են»,-ասաց Սարգիս Շահինյանը:

Դողու Փերինչեքը 2005 թվականի մայիս, հուլիս և սեպտեմբեր ամիսներին Շվեյցարիայի Լոզան, Օպֆիկոն և Կոնիզ քաղաքներումկազմակերպված միջոցառումների ընթացքում հրապարակայնորեն հերքել է 1915թ. և հետագա տարիներին հայ ժողովրդինկատմամբ Օսմանյան կայսրությունում տեղի ունեցած ցեղասպանության փաստը: Ն ա, մասնավորապես, Հայոցցեղասպանությունը որակել է որպես «միջազգային կեղծիք»: 2005 թվականի հուլիսին Շվեյցարիա-Հայաստան միությունը բողոք էներկայացրել Փերինչեքի դեմ՝ վերոհիշյալ ելույթների բովանդակության կապակցությամբ:

Այդ բողոքի հիման վրա Լոզանի դատարանը 2007 թվականի մարտի 9-ին Դողու Փերինչեքին մեղավոր է ճանաչել Շվեյցարիայիքրեական օրենսգրքի՝ ռասայական խտրականության համար պատասխանատվություն նախատեսող 261bis հոդվածի 4-րդ կետով:Լոզանի դատարանն արձանագրել է, որ Փերինչեքի՝ Հայոց ցեղասպանությունը ժխտող ելույթն ունեցել է ռասիստականշարժառիթներ, կրել է ազգայնական բնույթ և չի կարող դիտարկվել պատմական բանավեճի կամ քննարկման շրջանակներում:Լոզանի դատարանը նաև նշել է, որ Հայոց ցեղասպանությունը, ըստ շվեյցարական հանրային կարծիքի, համընդհանուրապացուցված եղելություն է, ապացուցված պատմական փաստ: Այս հիմնավորմամբ Դողու Փերինչեքը Շվեյցարիայումդատապարտվել է պայմանական ազատազրկման և տուգանքի:

Փերինչեքը Լոզանի դատարանի վճիռը բողոքարկել է շվեյցարական դատարանների տարբեր ատյաններ, սակայն արդյունքի չիհասել: Դիմելով Մարդու իրավունքների եվրոպական դատարան՝ Դողու Փերինչեքը պնդել է, որ շվեյցարական դատարանները,Հայոց ցեղասպանությունը ժխտելու մասին հրապարակային հայտարարությունների համար իրեն< /i> դատապարտելով, խախտելեն Եվրոպական կոնվենցիայի 10-րդ հոդվածով երաշխավորված իր խոսքի ազատությունը: 2015թ. Հունվարի 28-ին ՄԻԵԴ-ի Մեծպալատում տեղի են ունեցել «Փերինչեքն ընդդեմ Շվեյցարիայի» գործով դատական լսումները: ՀՀ գլխավոր դատախազ, ՄԻԵԴ-ումՀՀ կառավարության լիազոր ներկայացուցիչ Գևորգ Կոստանյանի գլխավորած փաստաբանական թիմի կազմում են ՀՀարդարադատության նախարարի տեղակալ, ՄԻԵԴ-ում ՀՀ կառավարության լիազոր ներկայացուցչի տեղակալ Արման Թաթոյանը,ՀՀ գլխավոր դատախազի տեղակալ Էմիլ Բաբայանը, Լոնդոնի Doughty Street փաստաբանական պալատի հիմնադիր, միջազգայինհայտնի< i> փաստաբան Ջեֆրի Ռոբերտսոնը, միջազգային հայտնի փաստաբաններ Ամալ Քլունին և Թոբի Քոլիսը:
