Պերմյակովի գործով դատավճիռը չի բողոքարկվել մեղադրողի կողմից

Գյումրիում Ավետիսյանների ընտանիքի սպանության համար ցմահ ազատազրկման դատապարտված ռուս զինծառայող Վալերի Պերմյակովի պատժի կրման վայրը կհստակեցվի  դատավճռի օրինական ուժի մեջ մտնելուց հետո: Պերմյակովի գործով դատավճիռը մեղադրողի կողմից չի բողոքարկվել, ինչը վկայում է այն մասին, որ մեղադրող կողմը համաձայն է առաջին ատյանի դատարանի կողմից տրված դատական գնահատականի հետ: Այս մասին հոկտեմբերի 15-ին Գյումրիում լրագրողների հետ ճեպազրույցի ժամանակ նշեց ՀՀ գլխավոր դատախազ Արթուր Դավթյանը:

Անդրադառանալով Պերմյակովի պատժի կրման վայրին՝ ՀՀ գլխավոր դատախազը նշեց, որ   այդ հարցը կորոշվի դատական ակտի ուժի մեջ գտնվելու փուլում: «Դա իր մեջ մի քանի պայմաններ ու «եթե»-ներ ունի:Կանցնենք դատական ակտի օրինական ուժի մեջ մտնելու փուլին՝ կունենանք այդ «եթե»-ների փուլը և  անպայման օրենքի սահմաններում լուծումները դուք  կտեսնեք»,-«Արմենպրես»-ի փոանցմամբ՝ նշեց Արթուր Դավթյանը:

Շիրակի մարզի առաջին  ատյանի դատարանն օգոստոսի 23-ին կայացած նիստի ժամանակ  ցմահ ազատազրկման դատապարտեց Գյումրիում Ավետիսյանների ընտանիքի յոթ անդամների սպանության մեջ մեղադրվող Վալերի Պերմյակովին՝ համադրելով Քրեական օրենսգրքի 104 հոդվածի 2-րդ մասի 1-ին, 5-րդ և 8-րդ կետերով (երկու կամ ավելի անձանց սպանությունը` առանձին դաժանությամբ, շահադիտական դրդումներով, պատվերով, ինչպես նաեւ զուգորդված՝ շորթմամբ, ավազակությամբ կամ բանդիտիզմով), 175 հոդվածի 2-րդ մասի 3-րդ, 4-րդ կետերով (ավազակային հարձակում, որը կատարվել է բնակարան, պահեստարան կամ շին ություն ապօրինի մուտք գործելով« զենքի կամ որպես զենք օգտագործվող այլ առարկաների գործադրմամբ) և 34-329 հոդվածի առաջին մասով (պետական սահմանի ապօրինի հատման փորձ) նախատեսված պատժաչափերը: Ցմահ պատժի հետ համադրվում է նաև ռուսական կողմի գործով 10 տարվա ազատազրկման պատիժը: Պատիժը կրելու ժամկետը հաշվվում է 2015թ-ի հունվարի 13-ից՝ Պերմյակովի կալանավորման օրվանից:

Ավետիսյանների ընտանիքի 6 անդամների սպանությունը տեղի է ունեցել 2015 թվականի հունվարի 12-ին՝ վաղ առավոտյան, ժամը 06:00-ի սահմաններում, նրանց մահը վրա է հասել հրազենային վնասվածքներից։ Ավետիսյանների ընտանիքից ողջ էր մնացել 6 ամսական փոքրիկը՝ Սերյոժա Արմենի Ավետիսյանը, ով կտրող-ծակող գործիքից ստացած վնասվածքներով տեղափոխվել էր բժշկական կենտրոն, այնուհետև` յոթ օր հետո մահացել: Կասկածյալին ռուս սահմանապահները հայտնաբերել են հայ-թուրքական սահմանը հատելու փորձ կատարելիս եւ հանձնել 102-րդ ռուսական բազայի հրամանատարությանը:

Քրեական գործը հարուցվել է ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 1-ին կետով (երկու և ավելի անձանց սպանությունը): Վալերի Պերմյակովին քրեական գործով որպես մեղադրյալ ներգրավելու մասին, և ՀՀ քննչական կոմիտեի քննիչները Վալերի Պերմյակովին  մեղադրանք են առաջադրել Հայաստանի Հանրապետության քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 1-ին կետով՝ երկու եւ ավելի անձանց դիտավորյալ սպանության համար: Վալերի Պերմյակովն ընդունել է առաջադրված մեղադրանքը:
