Կամայական մոտեցման արդյունքում սահմանափակվել է դեղերի ներմուծմամբ զբաղվող «Վիտա-ֆարմ» ընկերության գործունեությունը

 ՀՀ Տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովը ամփոփեց վարույթում գտնվող մի քանի գործեր, որոնք վերաբերում են շուկա մուտքի խոչընդոտների բացահայտմանն ու կանխարգելմանը: Այս մասին տեղեկանում ենք ՀՀ ՏՄՊՊՀ-ից:

Այսպես, հանձնաժողովի վարույթում է գտնվում դեղերի ներմուծման ոլորտում գործող «Վիտա Ֆարմ» ընկերության դիմում-բողոքի հիման վրա հարուցված գործը : Տնտեսվարողը դժգոհություն է հայտնել ՀՀ Առողջապահության նախարարության և վերջինիս ենթակայությամբ գործող «Դեղերի և բժշկական տեխնոլոգիաների փորձագիտական կենտրոն» ՓԲԸ կողմից մի շարք դեղերի ներմուծման և գրանցման գործընթացների առնչությամբ։ Ընկերությունը նշել է, որ վերոնշյալ կառույցների կողմից մերժվել են մի շարք դեղերի ներմուծումներ, իսկ մերժումները հակասում են ոլորտը կարգավորող իրա վական ակտերին՝ ստեղծելով խոչընդոտներ դեղերի շրջանառության ոլորտում գործունեություն ծավալելու առումով։ Հանձնաժողովի կողմից իրականացված բազակողմանի ուսումնասիրության արդյունքում պարզվել է, որ «Վիտա Ֆարմ» ընկերության կողմից ներկրված դեղերի ներմուծումը մերժվել է՝ դրանք մեր երկրում գրանցված չլինելու հիմքով: Ընդ որում, հարկ է նշել, որ դեղերը ներմուծվել են ոչ անմիջական արտադրողի կամ վերջինիս ներկայացուցչի, այլ՝ «զուգահեռ ներմուծման» ճանապարհով:

ՏՄՊՊՀ-ը կարևորում է նաև այն հանգամանքը, որ «Վիտա Ֆարմի» կողմից ներմուծվող դեղերի ձեռքբերման գները միջինում շուրջ 3 անգամ ավելի ցածր են եղել մեր երկրում միևնույն դեղերի իրացման մանրածախ գներից, ինչը նշանակում է, որ դրանք կարող էին շուկայում իրացվել էականորեն ավելի ցածր գներով:

Հարկ է նշել, որ ՀՀ-ում գրանցված և «Վիտա Ֆարմի» կողմից  ներմուծվող համանուն դեղերի միջև առկա են եղել փաթեթավորման ոչ էական՝ աննշան  տարբերություններ, որոնք, որևէ կերպ դեղի ներմուծումը մերժելու հիմք հանդիսանալ չէին կարող: Օրինակ, չնայած այն հանգամանքին, որ ընկերության կողմից ներմուծվող «Գալազոլին 0.05 %» դեղամիջոցը,  այս նույն անվանումով և նույն դեղաչափով գրանցված է մեր երկրում, սակայն ներկրման հայտը մերժվել է՝  այն պատճառաբանությամբ, որ գրանցված դեղորայքի վրա դեղաչափը (0.05%-ը) գրված է եղել տուփի վերևի մասում, մինչդեռ &la quo;Վիտա Ֆարմի» ներկայացրած տարբերակում՝ այն եղել է տուփի ներքևի մասում: Կամ ասենք,  «Հալիքսոլ 3մգ/մլ, օշարակ 100մլ» դեղի արտադրող հանդիսացող ռուսական «ԷԳԻՍ» ընկերությունը վերակազմավորվել է՝ ԲԲԸ-ից դառնալով՝ ՓԲԸ, ինչը սակայն  ՀՀ դեղերի պետական գրանցամատյանում չի արտացոլվել: Միայն այս հանգամանքը հիմք է հանդիսացել տվյալ դեղամիջոցի ներկրման արգելքի համար:

ՏՄՊՊՀ դիտարկմամբ, նման կամայական մոտեցումները  խոչընդոտ են հանդիսացել տնտեսվարող սուբյեկտների համար, ինչի արդյունքում սահմանափակվել է տնտեսական մրցակցությունը և միաժամանակ սպառողին զրկել առավել մատչելի գներով դեղորայք գնելու հնարավորությունից: Վերոնշյալ խնդրի ամբողջական լուծման նպատակով ուսումնասիրությունների փաթեթն ուղարկվել է ՀՀ Առողջապահության նախարարություն:
