Բժշկական օմբուդսմենը՝ բուժաշխատողների իրավունքների պաշտպանության սուբյեկտ

«Առողջապահությունը և մարդու իրավունքները» խորագիրը կրող առողջապահության իրավունքի առաջին միջազգային համաժողովը 3 օր շարունակ համախմբել էր առողջապահության և իրավունքի ոլորտի ներկայացուցիչներին: Համաժողովի շրջանակում բժշկական օմբուդսմենի ինստիտուտի մասին՝ որպես բուժաշխատողների իրավունքների պաշտպանության յուրահատուկ սուբյեկտ, զեկույցով հանդես եկավ «Երիտասարդ բժիշկների հայկական ասոցիացիայի» ներկայացուցիչ Մերի Կատվալյանը:

«Այս ինստիտուտը  դեռ Հայաստանում ներդրված չէ»,- Orer.am-ի հետ զրույցում հայտնեց Մերի Կատվալյանը:

«Բժշկական օմբուդսմենի ինստիտուտ ունեն առողջապահության զարգացած համակարգ ունեցող երկրները, մասնավորապես Մեծ Բրիտանիան, Կանադան, ԱՄՆ-ն: Կախված երկրի առողջապահության համակարգի ֆինանսավորման մոդելից՝ բժշկական օմբուդսմենի ինստիտուտը կա՛մ կատարում է առողջապահության համակարգի հաշտարարի դեր, ինչպես Կանադայի ու ԱՄՆ-ի պարագայում է, կա՛մ բուժաշխատողների շահերի պաշտպանի դեր,  ինչպես Մեծ Բրիտանիայում, արդյունավետ կերպով լուծում է բժիշկ-պացիենտ հարաբերությունում առաջացած վեճերը, հատկապես բուժման անարդյունավետ ելքերի դեպքում: Մեր երկրում բուժաշխատողի կողմից մասնագիտական պարտականությունները չկատարելը կամ ոչ պատշաճ կատարելը, որը հասարակական լայն շրջանակներում և լրատվամիջոցներում անվանում են բժշկական սխալ, մինչդեռ դա բժշկական անփութությունն է, կարգավորվում է ՀՀ Քրեական օրենսգրքով130-րդ հոդվածով: Մենք խնդիր ունենք տարբերելու բժշկական սխալը բժշկական անփութությունից»,- հավելեց նա:

Ինչպես նշեց Մ. Կատվալյանը, իրավագիտական գրականության մեջ «բժշկական սխալ» եզրույթի սահմանում չկա:  Համաձայն Հարվարդի համալսարանի սահմանման՝  բժշկական սխալը բուժաշխատողի կողմից բուժման ընթացքի վերաբերյալ ոչ ճիշտ որոշումների կայացումն է կամ բուժման ընտրված տարբերակի ձախողումը բուժման ընթացքում, սակայն դա լինում է ոչ թե կանխամտածված, այլ կարող է պայմանավորված լինել հիվանդության անսպասելի ու չնախատեսված զարգացմամբ: Բժշկական սխալը բուժաշխատողի բարեխիղճ մոլորությունն է, որը չի կարող ենթակա լինել քրեական պատասխանատվության:

Մանրամասնելով Մեծ Բրիտանիայում բժշկական օմբուդսմենի ինստիտուտի գործունեությունը՝ զրուցակիցն առանձնացրեց նպատակները, որոնց վրա էլ հիմնված է ողջ համակարգը. «Առաջին նպատակը բուժաշխատողների շահերի պաշտպանությունն է, երկրորդը՝ հիվանդի կամ պացիենտների դիմում-բողոքների արդյունավետ քննումը»:

Ըստ Մ. Կատվալյանի՝  այս ինստիտուտը կոչված է լուծել մարդու իրավունքների պաշտպանության խնդիրն առողջապահության ոլորտում:
