ՊԵԿ-Փաստաբանների պալատ համագործակցության արդյունքում պետություն-բիզնես շփման նոր հարթակ է ձևավորվել

 Տնտեսվարողների իրավունքների պաշտպանությունը նոր հարթություն է տեղափոխվում Պետական եկամուտների կոմիտեի և ՀՀ փաստաբանների պալատի համագործակցությամբ:

Նոյեմբերի 16-ին ՊԵԿ նախագահի տեղակալ Արմեն Սաքապետոյանը և ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանը երկու կառույցների միջև փոխըմբռնման հուշագիր են ստորագրել: Վերջինով նախատեսվում է համատեղ քննարկել հարկային և մաքսային ոլորտները կարգավորող իրավական ակտերում առկա բացթողումները, տարընթերցումները, մշակել նոր նախագծեր և լուծել մաքսային ու հարկային ոլորտներում վարչարարություն կամ դատավարական գործողություններ իրականացնելու ժամանակ ծագող խնդիրները: Այս մասին  տեղեկանում ենք ՀՀ ԿԱ ՊԵԿ տեղեկատվության և հասարակայնության հետ կապերի բաժնից:

«ՊԵԿ-ը, առաջնորդվելով հասարակության հետ բաց գործելաոճով շփվելու մոտեցմամբ, նախաձեռնել է ՀՀ փաստաբանների պալատի հետ հուշագրի կնքումը՝ բարձրացնելու համար տնտեսվարողների պաշտպանվածության մակարդակը»,-նշել է կոմիտեի նախագահի տեղակալ Արմեն Սաքապետոյանը: Հուշագրով նախատեսվում է ստեղծել հասարակական հիմունքներով գործող, 6 անդամից բաղկացած հանձնախումբ, որը կարող է դիմել ՊԵԿ և Փաստաբանների պալատ՝ համապատասխան աշխատակցի կամ փաստաբանի վարքագիծը քննելու առաջարկով: «Օրենքի սուբյեկտիվ մեկնաբանման կամ խախտման մասին տեղեկանալուց հետո հանձնախումբը կարող է շատ արագ արձագանքել՝ ներկայացնելով խնդիրը կառույցների ղեկավարությանը և հետամուտ լինելով արագ կարգավորմանը: Այս հուշագրի շահառուն քաղաքացին է, և նրա իրավունքների պաշտպանությունն է առաջնային»,-ընդգծել է Փաստաբանների պալատի նախագահ Արա Զոհրաբյանը՝ արձանագրելով նաև փաստաբաններին վերաբերող կարևոր դրույթի առկայությունը հուշագրում. «Անհատ ձեռնարկատեր փաստաբանի կամ փաստաբանական կազմակերպության նկատմամբ հարկային ստուգում նշանակելու դեպքում կոմիտեն այդ մասին գրավոր կծանուցի նաև Փաստաբանների պալատին»: Ար մեն Սաքապետոյանը վստահեցրել է, որ հուշագիրը գործնական նշանակություն է ունենալու՝ դրականորեն անդրադառնալով նաև ՊԵԿ-տնտեսվարող սուբյեկտ փոխհարաբերությունների բարելավման և պետական մարմնի գործառույթների պատշաճ իրականացման վրա. «Արդյունքում կձևավորվի պետություն-հասարակություն շփման նոր հարթակ, որը կաջակցի տնտեսվարողին՝ իր իրավունքների և շահերի պաշտպանության ուղղությամբ երաշխավորված օգնություն ստանալու հարցում»:

Վիճակագրությունը փաստում է, որ փաստաբանների համայնքի հետ կոմիտեն հաճախ է առնչվում: 2016թ. ընթացքում ՊԵԿ գանգատարկման հանձնաժողովին վարչական կարգով 326 բողոք է ներկայացվել, իսկ դատարաններում եղել է 1244 գործ: Վարչական և դատական կարգով բողոքների մոտ 90%-ը ներկայացվել է տնտեսվարողների շահերը ներկայացնող փաստաբանների կողմից: Այս տարի իրավախախտումների հայտնաբերման և վարչական վարույթների իրականացման վարչություն ստացված 1605 նյութերով և իրականացված վարչական վարույթներով մասնակցել է 32 փաստաբան: Իրավաբանական վարչության կողմից 2016թ. ընթացքում կայացվել է պարտավորությունների գանձման վերաբերյալ 8367, գույքի արգելադրման վերաբերյալ՝ 1665, իսկ վարչական տույժ նշանակելու մասին՝ 22 577 որոշում: Նշված գործողությունների արդյունքներով իրավաբանական ստորաբաժանումը 2016 թվականի ընթացքում կոմիտե ներկայացված փաստաբանական հարցումների վերաբերյալ տրամադրել է մոտ 400 պատասխան:
