«Մարիաննա» ընկերությունից պահանջել են հանել ապրանքը ռուսաստանյան շուկայից

Կաթնամթերքի արտադրությամբ զբաղվող «Դուստր Մարիաննա» ընկերությունից ռուսական «Дебор» և «Ногинский пищевой комбинат» ընկերությունները պահանջել են հանել առկա ապրանքը ՌԴ խանութներից և ոչնչացնել այն:

Ընկերությունը դիմել է ՀՀ Տնտեսական մրցակցության պաշտպանության պետական հանձնաժողով:  ՏՄՊՊՀ նոյեմբերի 22-ի նիստի ժա մանակ հանձնաժողովի իրավաբանական վարչության Իրավական ակտերի բաժնի պետ Շուշան Սարգսյանը նշեց, որ ռուսական «Дебор» և «Ногинский пищевой комбинат» ընկերությունները դիմել են «Դուստր Մարիաննային»՝ նշելով, որ իրենք հանդիսանում են «МАРИАННА» և «Marianne» ապրանքային նշանների իրավատերերը, և  հայկական ընկերությունը չի կարող այդ անվանումով արտադրանք ներկայացնել ռուսական շուկայում:

Ընկերության ներկայացուցիչները պահանջել են նաև 10-օրյա ժամկետում հանել առկա ապրանքը ՌԴ խանութներից և ոչնչացնել այն, հակառակ դեպքում կդիմեն վարչական, քաղաքացիական և քրեական պատասխանատվության մեթոդների: 

«Հանձնաժողովի ուսումնասիրությունները պարզել են, որ «Дебор» և «Ногинский пищевой комбинат» ընկերությունները կաթնամթերքի արտադրությամբ և իրացմամբ չեն զբաղվում և երբևէ չեն զբաղվել:

Բացի այդ, «Մրցակցության պաշտպանության մասին» ՌԴ օրենքով արգելվում է որևէ ապրանքային նշանի գրանցումը, եթե այն ուղղված է մրցակից ընկերություններին շուկայից դուրս մղելուն: Տվյալ պարագայում տնտեսվարողը գրանցել է մի ապրանքային նշան, որը օգտագործել է ոչ թե իր  արտադրանքը իրացնելու, այլ մրցակից տնտեսվարողների մուտքը շուկա սահմանափակելու նպատակով, ինչն օրենքի խախտում է՝ անբարեխիղճ մրցակցության գործողություն»,- ասաց նա:

Ռուսական «Дебор» և «Ногинский пищевой комбинат» ընկերությունների գործողություներն ուղղված են «Դուստր Մարիաննա» ընկերության արտադրանքի իրացումը ՌԴ-ում կանխելուն, հետևապես նաև  մրցակցության սահմանափակմանը: Այդ իսկ նպատակով ՀՀ ՏՄՊՊՀ-ն դիմել է ՌԴ գործընկերներին՝ ներկայացված խնդիրը Ռուսաստանի մրցակցային օրենսդրության խախտման տեսանկյունից ուսումնասիրելու և հայկական արտադրանքի անարգել մուտքը ռուսական շուկա ապահովելու նպատակով:

«Դուստր Մարիաննա» ՍՊԸ-ն դեռևս 1997-ից զբաղվում է կաթնամթերքի արտադրությամբ և մշտապես հանդես է եկել այդ ապրանքանիշով, որը  նաև 2007-ին  գրանցվել է Մտավոր սեփականության գործակալության կողմից:
