Հայաստանի արդյունաբերողների և գործարարների միության  նախագահությունը քննարկել է ՀՀ Տնտեսական Մրցակցության Պաշտպանության Պետական  Հանձնաժողովի կողմից (ՏՄՊՊՀ)   «Երևանի գարեջուր» ընկերությանը 110 միլիոն դրամի չափով տուգանելու մասին որոշումը: Ինչպես «Արմենպրես»-ին տեղեկացրին Հայաստանի արդյունաբերողների և գործարարների միության նախագահությունունից, քննարկման արդյունքում որոշվել է հետևյալը.

«ՀՀ  ՏՄՊՊՀ   որոշման քննարկումը մեզ հիմք է տալիս պնդելու, որ այն զուրկ է բովանդակային ծանրաբեռնվածությունից, իսկ դրա որոշ դրույթներ պարզապես հակասում են շուկայի տրամաբանությանը:

Մասնավորապես, դժվար է հասկանալ, թե խիստ մրցակցային դաշտում ապրանքի գնի բարձրացումը (ինչը ենթադրում է բյուջեյի լրացուցիչ մուտքեր) ինչպես կարելի է դիտարկել որպես գերիշխող դիրքի չարաշահում: Հասկանալի չէ նաև, թե ինչ չափանիշներով  է  հանձնաժողովը ապրանքի գնի բարձրացումը  դիտարկում որպես  չհիմնավորված՝ դրանով իսկ սահմանափակելով տնտեսվարող սուբյեկտի իրավունքները գնային քաղաքականության իրականացման հարցում:

Լուրջ  տարակուսանք են առաջացնում նաև Հանձնաժողովի գործելաոճը, դրան անհրաժեշտ թափանցիկության պակասը:

ՏՄՊՊՀ-ի որոշման վերլուծությունը մեզ հիմք է տալիս նաև հայտարարելու, որ լուրջ փոփոխությունների կարիք ունի «Տնտեսական մրցակցության պաշտպանության մասին» ՀՀ օրենքը՝ բացառելու համար այնտեղ առկա իրարամերժ դրույթներն ու տարընթերցումի հնարավորութունը, ինչը, փաստորեն, ցանկության դեպքում, կարող է օգտագործվել միակողմանի և կամայական որոշումների կայացման համար:

Կարծում ենք, որ քննարկվող որոշման ընդունումը անարդարացիորեն հարվածում է ներքին և արտաքին շուկաներում ճանաչում ձեռք բերած ընկերության վարկանիշին և հակասում է Հայաստանի Հանրապետության Կառավարության կողմից հռչակված պետություն-բիզնես փոխհարաբերությունների ձևավորման սկզբունքներին:

Հայաստանի արդյունաբերողների և գործարարների միությունը  հույս է հայտնում, որ Հանձնաժողովը կկասեցնի որոշման ընդունումը և կձեռնարկի մասնագիտական թափանցիկ քննարկումներ՝ բոլոր շահագրգիռ կողմերի մասնակցությամբ»:
