Հաշմանդամություն ունեցող անձանց վերաբերող օրենքը նպատակ ունի ապահովել նրանց իրավունքները

ՀՀ կառավարության կողմից մշակվել է «Հաշմանդամություն ունեցող անձանց իրավունքների պաշտպանության և սոցիալական ներառման մասին» ՀՀ օրենքի նախագիծը։ Այն հավանության է արժանացել ՀՀ կառավարության 2016 թվականի նոյեմբերի 3-ի նիստում և ներկայացվել ՀՀ Ազգային ժողով։ 

Նախագիծը մշակվել է հասարակական կազմակերպությունների մասնակցությամբ։ ՀՀ Մարդու իրավունքների պաշտպան Արման Թաթոյանը լրագրողների հետ զրույցում ասաց, որ հաշմանդամություն ունեցող անձանց վերաբերող օրինագիծն առաջնահերթ նպատակ է հետապնդում ապահովել հաշմանդամություն ունեցող անձանց իրավունքները, հատկապես պրակտիկ կյանքում, նրանց մասնակցությունը բոլոր գործընթացներին։ 

«Մենք ունենք առաջարկներ, որը ներկայացնելու ենք հանրային քննարկման։ Առաջարկները վերաբերում են երեխաների, կանանց և տղամարդկանց լիարժեք և հավասար մասնակցության հետ կապված այս կամ այն հարցերին»,- նշեց Թաթոյանը։ 

Նա նաև հավելեց, որ կոնվենցիան նախատեսում է հատուկ մարմնի ստեղծում, որը պատասխանատու կլինի հաշմանդամություն ունեցող անձանց իրավունքների պաշտպանության մոնիտորինգի, խախտումները կանխարգելելու համար։ Նրա խոսքով` այդ մարմինը պետք է լինի անկախ։       

«Հաշմանդամություն ունեցող անձանց շահերի պաշտպանության ազգային դաշինք» իրավաբանական անձանց միության գործադիր տնօրեն Զարուհի Բաթոյանն ասաց, որ Հայաստանում խնդիրը կապված է, ոչ թե օրենքների և նախագծերի, այ լ դրանց իրականացման և մեխանիզմների հետ։

«Այս պահի դրությամբ գործում է հաշմանդամների սոցիալական պաշտպանության մասին օրենքը, որը իրականում վատ օրենք չէ։ Եթե այն բավականին լավ իրականացվի, շատ հարցեր կլուծվեն։ Կրթության հետ կապված հարցերը լուծվում են, օրենքը ապահովում է բոլոր խնդիրների լուծումները։

Հարցն այլ է. հաշմանդամություն ունեցող անձանց իրավունքների պաշտպանության տեսանկյունից իրավունքի վրա հիմնված նախագիծ, որպես այդպիսին, մենք չունենք։ Արդեն ընդունված նախագիծը պարտադրվում է հաշմանդամություն ունեցող անձանց իրավունքների կոնվենցիայով։

Մենք 2010 թվականից վավերացրել ենք կոնվենցիան և դրան համապատասխան իրավունքի վրա հիմնված օրենք, նախագիծ չունենք»,- ասաց Բաթոյանը: Նրա խոսքով` դեռ շատ խնդիրներ կան և շատ առաջարկներ եղել են տարբեր ՀԿ-ների կողմից, որոնց մի մասը հաշվի առնվել է։

Բավականին շատ խնդիրներ դեռևս լուծած չեն և շատ վիճելի են։ 
ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմը ԵԱՀԿ երևանյան գրասենյակի աջակցությամբ կազմակերպում է օրենքի նախագծի հանրային քննարկում։ Հնչած բոլոր կարծիքները կամփոփվեն և կներկայացվեն ՀՀ Ազգային ժողով։
