ՀՔԾ-ն երեք ամբաստանյալների մեղադրանք է առաջադրել ակնհայտ սուտ մատնություն համար

ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննության ընթացքում իրականացված մի շարք քննչական և դատավարական գործողությունների արդյունքում ակնհայտ սուտ մատնություն կատարելու համար մեղադրանքներ են առաջադրվել Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանում գողության վերաբերյալ քննվող քրեական գործով  3 ամբաստանյալների:

Ինչպես տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից, քրեական գործի նախաքննության ընթացքում հիմնավորվել է, որ ՀՀ քննչական կոմիտեի Գեղարքունիքի մարզային քննչական վարչության վարույթում գողության դեպքի առթիվ հարուցված և քննվող քրեական գործի նախաքննությունն իրականացրած քննիչները հայերեն գրավոր լեզվին չտիրապետող Ա. Հ.-ի և դատավարության  մյուս մասնակիցների միջև առերես հարցաքննություններ են անցկացրել, որոնց մասնակցել են հանրային պաշտպանը և թարգմանիչը: Մինչդեռ Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանում նույն դեպքի վերաբերյալ քննվող քրեական գործով ամբաստանյալներ, հայերեն գրավոր լեզվին չտիրապետող Ա. Հ.-ն, ինչպես նաև Ա. Ս.-ն և Ա. Բ.-ն, նախազգուշացված լինելով սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին և գիտակցելով, որ իրենց կողմից տրված տեղեկատվությունը կեղծ է, նույնաբովանդակ հաղորդում են ներկայացրել, թե, իբր, առերես հարցաքննություններին թարգմանիչ չի մասնակցել, իսկ հետագայում  քննիչները արձանագրությունների մեջ մտցրել են կեղծ տեղեկություններ թարգմանչի մասնակցության վերաբերյալ,  իսկ վերջինս ու հանրային պաշտպանը, իրենց ստորագրություններով հաստատելով արձանագրությունները, օժանդակել են քննիչների կողմից պաշտոնեական կեղծիք կատարելուն:

Այս կերպ 3 ամբաստանյալները հանցագործության կատարման մեջ անհիմն մեղադրել են ՀՀ քննչական կոմիտեի Գեղարքունիքի մարզային քննչական վարչության քննիչներին, թարգմանչին և պաշտպանին:

Քրեական գործի նախաքննության ընթացքում ձեռք բերված ապացույցներով որոշում է կայացվել հիշյալ վարչության քննիչների նկատմամբ քրեական հետապնդում չիրականացնել՝ հանցագործության դեպքի բացակայության պատճառով:

Միաժամանակ, ակնհայտ սուտ մատնություն կատարելու դեպքի առթիվ, ՀՀ հատուկ քննչական ծառայությունում, հարուցված քրեական գործով 3 ամբաստանյալների մեղադրանքներ են առաջադրվել ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասով:

Քրեական գործի նախաքննությունը շարունակվում է:

Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցվածչէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
