ՀՀ ոստիկանության անձնագրային և վիզաների վարչության պետ, ոստիկանության գնդապետ Մնացական Բիչախչյանը դեկտեմբերի 27-ին Skype-ի միջոցով պատասխանել է հայրենակիցներին հետաքրքրող հարցերին, որոնք վերաբերել են ՀՀ վերադարձի վկայական տալու կարգին և երեխայի համար ՀՀ քաղաքացու անձնագիր ստանալու հիմքերին։

Այս մասին տեղեկացնում է ՀՀ ոստիկանության պաշտոնական կայքը, որի հաղորդագրության մեջ նաև նշված է. «Զանգահարել է օտարեկրյա պետությունում գտնվող քաղաքացին և տեղեկացրել, որ հանդիսանալով նախկին ՀԽՍՀ քաղաքացի՝ ներկայումս բնակվում է ՌԴ-ում: Անձնագրային և վիզաների վարչությունից դիվանագիտական ճանապարհով ստացել է տեղեկանք, համաձայն որի՝ հանդիսանում է Հայաստանի քաղաքացի, եթե մինչև 1995 թվականի նոյեմբերի 28-ը (այսինքն «ՀՀ քաղաքացիության մասին» օրենքի ուժի մեջ մտնելը) ձեռք չի բերել այլ պետության քաղաքացիություն:

Ներկայումս ցանկանում է վերադառնալ Հայաստան, որպեսզի տեղում ստանա ՀՀ քաղաքացու անձնագիր, սակայն վերադարձի վկայական ստանալու համար իրենից պահանջում են տեղեկանք՝ այլ պետության քաղաքացիության բացակայության մասին: Քաղաքացին ցանկանում էր տեղեկանալ, թե իրավաչա ՞փ է նման պահանջը:

Պարզաբանվել է ՀՀ օրենսդրության պահանջը: Համաձայն ՀՀ կառավարության 2011 թվականի մարտի 24-ի «Հայաստանի Հանրապետության վերադարձի վկայականի նկարագիրը և տալու կարգը հաստատելու մասին» թիվ 297-Ն որոշմամբ հաստատված 2-րդ հավելվածի 5-րդ կետի՝ վերադարձի վկայական ստանալիս նախկին ՀԽՍՀ քաղաքացու անձնագիր ներկայացնելու դեպքում ներկայացվում է նաև դիմումն ընդունող հյուպատոսական հիմնարկի նստավայր պետության կամ հյուպատոսական տարածաշրջանի համապատասխան պետության քաղաքացիությունը ժխտող տեղեկանք:

Զանգահարել է ՌԴ-ում գտնվող քաղաքացին և տեղեկացրել, որ իրենց երրորդ երեխան ծնվել է այնտեղ: Ցանկանում էր տեղեկանալ, թե կարո՞ղ են արդյոք երեխայի համար ստանալ ՀՀ քաղաքացու անձնագիր և օտարերկյա պետությունում ծնվելու հանգամանքը խոչընդոտ չի՞ հանդիսանում: Հավելյալ տեղեկացրել է, որ ինքը և կինը հանդիսանում են ՀՀ քաղաքացիներ: Պարզաբանվել է գործող կարգը, համաձայն որի՝ ՀՀ քաղաքացիներից ծնված երեխան, անկախ այն հանգամանքից որտեղ է ծնվել, օրենքի ուժով ձեռք է բերում ՀՀ քաղաքացիություն: Հետևաբար, կարող են դիմել օտարերկյա պետությունում գտնվող դիվանագիտական ծառայություն երեխային ՀՀ քաղաքացու անձնա գիր ստանալու համար»:
