ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում ձեռնարկված քննչական գործողությունների արդյունքում բացահայտվել են ՍՊԸ-ից առանձնապես խոշոր չափերով խարդախություն և յուրացում կատարելու դեպքեր: Քննությամբ բավարար ապացույցներ են ձեռք բերվել, որ հափշտակությունները կատարվել են 2014-2015թթ., որոնց հետևանքով ՍՊ ընկերությանը պատճառվել է առանձնապես խոշոր չափերի գույքային վնաս:

Ձեռնարկված անհրաժեշտ քննչական գործողությունների արդյունքում բացայատվել է առերևույթ հանցագործություն կատարած անձանց ինքնությունը, անհատականացվել նրանցից յուրաքանչյուրի գործողությունները, կատարման եղանակը, պարզվել պատճառված վնասի չափը։

Մասնավորապես՝ Կ.Կոստանյանը, աշխատելով ՍՊԸ-ի կոմերցիոն բաժնում որպես կորպորատիվ հաճախորդների մենեջեր և հանդիսանալով նյութական պատասխանատու անձ, 2014-2015թթ. ընթացքում տարբեր ընկերությունների անվամբ համապատասխան հաշիվ ապրանքագրերի հիման վրա դուրս է գրել առանձնապես խոշոր չափերով՝ ընդհանուր 65.617.500 ՀՀ դրամ գումար արժողությամբ տարբեր տեսակի ավտոպահեստամասեր` անվադողեր, անվահեծեր, շարժիչի յուղ, զտիչ և մարտկոցներ, որոնք խարդախությամբ հափշտակել է: Հափշտակված ավտոպահեստամասերը Կ.Կոստանյանը վաճառել է, իսկ վաճառքից ստացված միջոցները տնօրինել իր հայեցողությամբ։

Նախաքննությամբ նաև հիմնավորվել է, որ Մ.Վարդանյանը, աշխատելով նույն ընկերության կոմերցիոն բաժնում` որպես մեծածախ վաճառքի մենեջեր, և հանդիսանալով նյութական պատասխանատու անձ, 2014-2015թթ. ընթացքում տարբեր տնտեսվարող սուբյեկտներից ստացված՝ իրեն վստահված գումարները դրամարկղ կամ բանկային հաշվին չմուտքագրելով, ետ ստացած ավտոպահեստամասերը պահեստ չմուտքագրելու, մատակարարելու նպատակով ընկերությունից ապրանքներ ելքագրելու միջոցով յուրացման եղանակով հափշտակել է առանձնապես խոշոր չափերի՝ 46.794.452 ՀՀ դրամի գույք, որից 24.896.752 ՀՀ դրամին համարժեք ավտոպահեստամասեր և 21.897.700 ՀՀ դրամ։

Ձեռնարկված քննչական գործողությունների արդյունքում պարզվել է կատարված հափշտակության մեխանիզմը։

Մինչդատական վարույթում ձեռք բերված բավարար ապացույցների հիման վրա՝ Կ.Կոստանյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 3-րդ մասի 1-ին կետի, իսկ Մ.Վարդանյանին՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետի հատկանիշներով:

Նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
