Պաշտոնատար անձինք հանիրավի մեղադրվել են պաշտոնեական հանցագործություններ կատարելու մեջ

Երկու դրվագով սուտ մատնություն կատարելու դեպքի վերաբերյալ իրականացված նախաքննության արդյունքում մեղադրանք է առաջադրվել ՀՀ արդարադատության նախարարության «Արմավիր» քրեակատարողական հիմնարկի կալանավոր, բնակարանային գողության մեջ մեղադրվող Տիգրան Հարությունյանին, ով ՀՀ հատուկ քննչական ծառայությանը կեղծ տեղեկություններ է  հաղորդել ոստիկանի ու քննիչի կողմից պաշտոնեական կեղծիք կատարելու և կաշառք ստանալու մաս ին: \

Այս մասին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից՝ հավելելով. «Ըստ  նախաքննությամբ ձեռք բերված տվյալների` Տ. Հարությունյանին 20.07.2016-ին գողության կասկածանքով բերման են ենթարկել ոստիկանություն և խուզարկել: Սակայն, որոշ ժամանակ անց, Տ. Հարությունյանը ՀՀ հատուկ քննչական ծառայությանը կեղծ հաղորդում է տվել այն մասին, թե, իբր, ոստիկանության օպերլիազոր Ա. Կարակոզյանն իրեն անձնական խուզարկության չի ենթարկել, հետևաբար` չի հայտնաբերել այդ ժամանակ իր մոտ եղած 35.000 ՀՀ դրամը, այնուհետև կազմել է ձևական արձանագրություն, որում նշել է, թե ընթերակաների մասնակցությամբ խուզարկություն է կատարվել: Նախաքննության արդյունքում, սակայն, պարզվել է, որ Տ. Հարությունյանը սուտ մատնություն է կատարել` ոստիկանության աշխատակցին հանիրավի մեղադրելով պաշտոնեական կեղծիք կատարելու մեջ:

Բացի այդ, կալանավորը սուտ տվյալներ է հաղորդել ՀՀ քննչական կոմիտեի ավագ քննիչ Ս. Հովհաննիսյանի մասին: Մասնավորապես, հայտնել է, թե, իբր, ոստիկանությունից  ՀՀ քննչական կոմիտեի քննչական բաժին տեղափոխվելուց հետո նշված 35.000 դրամը որպես կաշառք տվել է Ս. Հովհաննիսյանին՝ խնդրելով իր նկատմամբ որպես խափանման միջոց կիրառել չհեռանալու մասին ստորագրությունը, սակայն գումարը վերցնելուց հետո վերջինս խոստումը չի կատարել: Տ. Հարությունյանը կալանավորվել է:

Սուտ մատնություն կատարելու ևս երկու դեպքի վերաբերյալ կատարված լրիվ և բազմակողմանի քննությամբ հիմնավորվել է, որ նախկին կալանավորներ Վահագն Ավագյանը և Արմեն Այվազյանը հանցագործության մասին սուտ մատնություն են կատարել և ոստիկանության ավագ քննիչ Սամվել Հովհաննիսյանին հանիրավի մեղադրել պաշտոնեական կեղծիք կատարելու մեջ: 

Թե՛ Վ. Ավագյանը և թե՛ Ա. Այվազյանը կեղծ տեղեկություններ են հաղորդել այն մասին, որ Ս. Հովհաննիսյանի վարույթում գտնվող քրեական գործով կատարված քննչական գործողությանը որպես ընթերակա չեն մասնակցել և այդ կապակցությամբ կազմված արձանագրությունում, առհասարակ, որևէ գրառում չեն կատարել: Սակայն Հատուկ քննչական ծառայությունում իրականացված նախաքննության արդյունքում պարզվել է, որ նշված  անձինք իրականում մասնակցել են քննչական գործողությանը և որպես ընթերակա ստորագրել քննիչի կազմած արձանագրությունում:

Այսպիսով, սուտ մատնություններ կատարելու համար Տիգրան Հարությունյանին, Վահագն Ավագյանին և Արմեն Այվազյանին մեղադրանքներ են առաջադրվել ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասով: Դեպքերի առթիվ հարուցված քրեական գործերի նախաքննությունն ավարտվել է: Գործերը մեղադրական եզրակացությամբ հանձնվել են դատավարական հսկողություն իրականացնող դատախազին` դրանք հաստատելու և դատարան ուղարկելու համար:

Ի դեպ, ՀՀ հատուկ քննչական ծառայությունը տեղեկացնում է, որ  նախորդ տարվա համեմատ`  սուտ մատնությունների թվի էական աճ է արձանագրվել. եթե 2015թ.-ին սուտ մատնության դեպքերի առթիվ հարուցվել էր ընդամենը 17 քրեական գործ, ապա 2016 թ.-ին դրանց թիվը կտրուկ աճել է` կազմելով 46 գործ: Բոլոր քրեական գործերով մեղավոր անձինք ենթարկվել են քրեական պատասխանատվության:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»:
