Հարկադիր կատարման ծառայության պաշտոնյաները շուրջ 10 տարի չեն կատարել դատական ակտը

Դատական ակտը դիտավորությամբ չկատարելու դեպքի առթիվ հարուցված քրեական գործով ՀՀ հատուկ քննչական ծառայությունում կատարված լրիվ և բազմակողմանի նախաքննության արդյունքում հիմնավորվել է, որ ՀՀ ԱՆ ԴԱՀԿ ծառայության Կենտրոնական մարմնի հարկադիր կատարման օպերատիվ բաժնի պետ Ա. Մարտիրոսյանը և նրա տեղակալ Գ. Հովհաննիսյանը չեն կատարել իրենց ծառայողական պարտականությունները` շուրջ 10 տարի անտեսելով ապօրինի կառուցված  կախովի պատժգամբն ապամոնտաժելու վերաբերյալ դատարանի վճիռը:

Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Կատարված քննչական գործողությունների ընթացքում պարզվել է, որ ԴԱՀԿ ծառայության Կենտրոնական մարմնի հարկադիր կատարման օպերատիվ բաժնի պետի տեղակալ Գ. Հովհաննիսյանը դեռևս 04.12.2006թ.-ին ստացված կատարողական թերթիկի հիման վրա պետք է ապամոնտաժեր Իրա Հակոբյանի կողմից Երևանի Լեոյի փողոցի 37 հասցեում  ապօրինի կառուցված  կախովի պատշգամբը:

Չնայած նշված պահանջը պետք է կատարվեր օրենքով սահմանված երկամսյա ժամկետում, սակայն Գ. Հովհաննիսյանը տարբեր պատճառաբանություններով շուրջ 10 տարի խուսափել և չի ապամոնտաժել  ապօրինի կառուցված պատշգամբը, ինչի հետևանքով էական վնաս է պատճառել քաղաքացի Մ. Գասպարյանի իրավունքներին և օրինական շահերին: Վերջինս հարկադիր կատարողի անգործության հետևանքով զրկվել է իրեն պատկանող ավտոտնակն օգտագործելու հնարավորությունից, ավելին` տարիներ շարունակ անպատասխան են մնացել այդ կապակցությամբ նրա կողմից տարբեր իրավասու մարմիններ ուղարկված բազմաթիվ դիմում-բողոքները:

Ի վերջո, քաղաքացին որոշել է դեպքի վերաբերյալ հաղորդում տալ Հատուկ քննչական ծառայությանը, որտեղ էլ  հիշյալ հաղորդման հիման վրա քրեական գործ է հարուցվել:

Գործով իրականացված նախաքննության ժամանակ նաև բացահայտվել է, որ ի իր ծառայողական պարտականությունները չի կատարել ոչ միայն ԴԱՀԿ ծառայության Կենտրոնական մարմնի հարկադիր կատարման օպերատիվ բաժնի  պետի տեղակալը, այլ նաև նույն բաժնի պետ Ա. Մարտիրոսյանը, ով հարկադիր կատարողի կողմից կատարողական վարույթով սահմանված երկամսյա ժամկետում դատական վճիռը կատարելու նկատմամբ պատշաճ հսկողություն չի իրականացրել և միջոցներ չի ձեռնարկել նրա անգործությունը վերացնելու ուղղությամբ:

Այսպիսով,  2006–2015թթ.-ի ընթացքում  ԴԱՀԿ ծառայության պաշտոնյաները շարունակ ձգձգել և չեն ապամոնտաժել ապօրինի կառույցը`  էական վնաս պատճառելով նաև պետության օրինական շահերին, ինչի հետևանքով հեղինակազրկվել է ՀՀ ԱՆ ԴԱՀԿ ծառայությունը, իսկ դատական ակտի պահանջներն այդպես էլ մնացել են անկատար:

Կատարած հանցավոր արարքների համար ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 1-ին մասով մեղադրանքներ են առաջադրվել Ա. Մարտիրոսյանին և Գ. Հովհաննիսյանին: Քրեական գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
