Լապշինին Ադրբեջանին հանձնելով՝ Բելառուսը քաղաքական շահերը վեր է դասում ժողովրդավարական նորմերից. ԼՂՀ ԱԳՆ

ԼՂՀ արտաքին գործերի նախարարությունը մեկնաբանել է Բելառուսի Գերագույն դատարանի որոշումը, որով մերժվում է Արցախ այցելած բլոգեր Ալեքսանդր Լապշինի գործով բողոքը։

Ինչպես տեղեկացրին ԼՂՀ արտգործնախարարության տեղեկատվական վարչությունից, պատասխանելով «Արցախպրես»-ի հարցին՝ «ինչպե՞ս կմեկնաբանեք Բելառուսի Գերագույն դատարանի որոշումը, որով մերժվում է Ալեքսանդր Լապշինի գործով բողոքը», ԼՂՀ ԱԳՆ-ում նշել են. «Բելառուսի Գերագույն դատարանի դատավճիռը, որն ուժի մեջ է թողնում հայտնի բլոգեր Ալեքսանդր Լապշինին քրեական հետապնդման նպատակով Ադրբեջանին հանձնելու որոշումը, ոչ միայն հանդիսանում է Ադրբեջանի կողմից իրականացվող օտարերկրյա քաղաքացիերին ահաբեկելու քաղաքականության ակնհայտ աջակցության դրսևորում, այլև ազատ տեղաշարժի և խոսքի ազատության հիմնարար իրավունքների կոպիտ ոտնահարում։

Մտադիր լինելով, ի պատասխան Բաքվի հայցի, Ադրբեջանին հանձնել Ալեքսանդր Լապշինին՝ շինծու և քաղաքականացված գործի հիման վրա, բելառուսական իշխանությունները ցուցադրում են, որ քաղաքական շահերը վեր են դասում ժողովրդավարական նորմերից, ինչպես նաև օրինականության և արդարության սկզբունքներից»։

Բելառուսի Գերագույն դատարանը մերժել է Ռուսաստանի և Իսրայելի քաղաքացի, բլոգեր Ալեքսանդր Լապշինի բողոքը՝ կապված Բելառուսի Գլխավոր դատախազության որոշման հետ, որով Լապշինը պետք է արտահանձնվի Ադրբեջան։

Բելառուսի Գերագույն դատարանը բլոգերի բողոքարկումը քննել է կես ժամից ավելի քիչ ժամանակահատվածում: Լապշինի փաստաբան Նատալյա Շեկինան տեղեկացրել է, որ իր պաշտպանյալը դատարանի դահլիճում չի եղել: Նա հայտնել է, որ Լապշինի կինը դիմել է Մինսկի ներքին գործերի գլխավոր վարչության քաղաքացիության և միգրացիայի բաժին` պահանջելով տրամադրել հավելյալ պաշտպանություն: Բացի այդ, նա բողոք է ներկայացրել ՄԱԿ-ի մարդու իրավունքների կոմիտե, որն արդեն բողոքն ընդունել է քննարկման:

Բելառուսի Գերագույն դատարանի կողմից Լապշինին Բաքու արտահանձնելու մասին որոշումն օրինական համարելու դեպքում այն ուժի մեջ կմտնի հրապարակման պահից սկսած: Ադրբեջանում ՌԴ և Իսրայելի քաղաքացի բլոգերին սպառնում է քրեական հետապնդում 281.2 (երկրի դեմ ուղղված հրապարակային կոչեր) և 318 (Ադրբեջանի Հանրապետության պետական սահմանի անօրինական հատում) հոդվածներով: Երկու հոդվածներով Լապշինին սպառնում է մինչև 5 տարվա ազատազրկում:

Մինսկի ոստիկանությունը 2016 թվականի դեկտեմբերի 15-ին ձերբակալել է Լապշինին, ով բնակվում է Մոսկվայում և գրում է ռուսերեն հեղինակավոր Travel Blog-ի համար: Նա որոնվում է Ադրբեջանում 2011 թվականի ապրիլին, 2012 թվականի հոկտեմբերին և 2016 թվականի հունիսին Լեռնային Ղարաբաղ այցելելու, ինչպես նաև իր բլոգում Ադրբեջանի քաղաքականությունը քննադատելու համար: Ադրբեջանը 2011 թվականին նրան ներառել էր իր կողմից որոնվող անձանց ցուցակում: Պաշտոնական Բաքուն պահանջում է Բելառուսի իշխանություններից Լապշինին արտահանձնել իրենց:

Բելառուսի Հանրապետության գլխավոր դատախազի տեղակալը որոշում է կայացրել բավարարել Ադրբեջանի Հանրապետության գլխավոր դատախազության խնդրանքը՝ Ռուսաստանի Դաշնության և Իսրայելի պետության քաղաքացի Ալեքսանդր Լապշինին հանձնելու վերաբերյալ՝ Ադրբեջանի քրեական օրենսգրքի 281.2 և 318.2 հոդվածներով քրեական պատասխանատվության ենթարկելու համար։

Թեպետ Լապշինը բողոքարկել է դատախազության որոշումը, սակայն նրա բողոքարկումը մերժվել է:
