 Մարդու իրավունքների պաշտպանի աշխատակազմում մանրամասն ուսումնասիրվել են մի շարք փաստաբանների հրապարակային պնդումներն այն մասին, որ քրեակատարողական հիմնարկներում փաստաբանների համար ստեղծվում են խոչընդոտներ: Խոսքը հատկապես վերաբերում է քրեական գործով պաշտպան հանդիսացող փաստաբանների աշխատանքին իրենց պաշտպանյալների հետ: Այս մասին տեղեկացրին Մարդու իրավունքների պաշտպանի աշխատակազմից:

Մասնավորապես, ըստ այդ տեղեկությունների՝  քրեակատարողական ծառայողների կողից ստեղծվում են խոչընդոտներ՝ կապված պաշտպանյալների հետ փաստաբանների առանձնազրույցների, փաստաբաններին անձնական խուզարկության ենթարկելու փորձերի, փաստաբանների մոտ առկա փաստաթղթերը ստուգման ենթարկելու հետ և այլն: Այս մասին Մարդու իրավունքների պաշտպանի աշխատակազմի արագ արձագանքման ստորաբաժանմանը տեղեկացրել է նաև փաստաբան Մուշեղ Շուշանյանը:

Մարդու իրավունքների պաշտպանն անհրաժեշտ է համարում արձանագրել, որ փաստաբանների մասնագիտական աշխատանքը և հատկապես՝ նրանց աշխատանքը քրեակատարողական հիմնարկում ենթակա է բարձր պաշտպանության: Իրավաբանական օգնությանը, փաստաբանական գաղտնիքին առնչվող փաստաթղթերը կամ տեղեկատվական կրիչներն անձեռնմխելի են: Դրանք չեն կարող հասանելի լինել նաև քրեակատարողական ծառայողներին: Փաստաբանը պաշտպանված է նաև խուզարկությունից իր մասնագիտական պարտականություններն անմիջականորեն կատարելիս: Այս երաշխիքներն ինքնանպատակ չեն. դրանք կոչված են ապահովելու փաստաբանի անխոչընդոտ աշխատանքը և իրավաբանական օգնության կարիք ունեցող անձի իրավունքների լիարժեք իրացումը:

Հաշվի առնելով «Մարդու իրավունքների պաշտպանի մասին» օրենքի պահանջները՝ Պաշտպանի աշխատակազմում սկսվել է հարցի քննարկման ընթացակարգ: Օրենքի պահանջի համաձայն՝ պարզաբանումներ են պահանջվել բոլոր այն հարցերի վերաբերյալ, որոնք բարձրացված են փաստաբանների հրապարակային մտահոգություններում: Պարզաբանումների  պահանջ ներկայացնելիս հաշվի է առնվել նաև ՀՀ փաստաբանների պալատի դիրքորոշումը այս հարցի առնչությամբ: Մարդու իրավունքների պաշտպանի աշխատակազմն այս հարցում կհամագործակցի նաև մտահոգություն ներկայացրած փաստաբանների հետ:
