Կաշառքի դիմաց վարորդական իրավունքի վկայական տրամադրելու գործով մեղադրանք է առաջադրվել երկու ոստիկանի

Փաստացի ավտոմեքենա վարելու հմտություններ չունեցող անձին կաշառքի դիմաց վարորդական իրավունքի վկայական տրամադրելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում հարուցված քրեական գործի նախաքննության արդյունքում բացահայտվել են կատարված հանցագործության բոլոր հանգամանքները, մեղադրանք է առաջադրվել 6 անձի, այդ թվում` 2 ոստիկանի: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծա ռայությունից:

Այսպես, քննությամբ պարզվել է, որ Երևան քաղաքի բնակիչ Մովսես Մանուկյանը վարորդական իրավունքի վկայական ստանալու նպատակով դիմել է իր ծանոթ Ժորա Չերքեզյանին, ով համոզել է իր միջոցով 145.000 դրամի կաշառք տալ ՀՀ ոստիկանության  «Ճանապարհային ոստիկանություն» ծառայության պաշտոնատար անձանց` խոստանալով կազմակերպել քննությունների անխոչընդոտ հանձնումը և վարորդական իրավունքի վկայականի ստացումը: Մ. Մանուկյանը սկզբում համաձայնվել և պայմանավորվել է մի քանի օր անց հանդիպել, սակայն հետագայում մտափոխվել է և այդ մասին տեղեկացրել ՀՀ ԿԱ ազգային անվտանգության ծառայությանը:

Այնուհետև, պայմանավորված օրը՝ 21.02.2016 թ.-ին, Մ. Մանուկյանը օպերատիվ հետախուզական միջոցառման շրջանակներում ԱԱԾ աշխատակիցներից ստացած համապատասխան գումարը փոխանցել է Ժ. Չերքեզյանին, ով իր ծանոթ Աշոտ Խաչատրյանի  և ոստիկանության ծառայողական ավտոմեքենայի վարորդ Արամ Օհանյանի միջոցով կաշառքը փոխանցել է ՀՀ ոստիկանության ՃՈ Երևանի հաշվառման-քննական բաժնի աշխատակից Գևորգ Թադևոսյանին: Վերջինս, սակայն, գումարը չի փոխանցել հիշյալ բաժնի պաշտոնատար անձանց, այլ, օգտագործելով նրանց հետ ունեցած անձնական կապերը, կազմակերպել է Մ.Մանուկյանի կողմից տեսական և գործնական քննությունների անխոչընդոտ հանձնումը: Մասնավորապես, Մ. Մանուկյանը տեսական քննության ժամանակ առանց հարցերին լիարժեք պատասխանելու գնահատվել է դրական և գործնական քննությանը մասնակցելու հնարավորություն ստացել: Գործնական քննության ընթացքում թեպետ Մ. Մանուկյանը ավտոմեքենան վարել է ճանապարհային երթևեկության կանոնների կոպիտ խախտումներով, սակայն հաշվառման-քննական բաժնի տեսուչներ Արման Հարությունյանը և Հարություն Գրիգորյանը, չարաշահելով իրենց պաշտոնեական լիազորությունները, խախտել են ՀՀ կառավարության համապատասխան որոշման պահանջները և առանց օրինական հիմքերի քննությունների արդյունքները գնահատել դրական: Արդյունքում, տեսական գիտելիքներ և փաստացի ավտոմեքենա վարելու գործնական հմտություններ չունեցող Մ. Մանուկյանը ստացել է «B» և «C» կարգերի վարորդական իրավունքի վկայական:   

Այսպիսով, Ժ. Չերքեզյանի դրդչության արդյունքում Մ. Մանուկյանը իր վարորդական իրավունքի վկայականը ստանալու համար փորձել է կաշառք տալ պաշտոնատար անձանց, իսկ Ա. Խաչատրյանը և Ա. Օհանյանը կատարել են բոլոր անհրաժեշտ գործողությունները` նշված գումարը պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց փոխանցելու համար, սակայն Գ.Թադևոսյանի կողմից այն վերջիններիս չփոխանցելու պայմաններում հանցագործությունն ավարտին չի հասցվել։   

Կատարած հանրորեն վտանգավոր արարքների համար Ժ. Չերքեզյանին մեղադրանք է առաջադրվել  ՀՀ քրեական օրենսգրքի 38-34-312-րդ հոդվածի 1-ին մասով, Ա. Խաչատրյանին և Ա. Օհանյանին` ՀՀ քրեական օրենսգրքի 34-313-րդ հոդվածի 1-ին մասով, Գ. Թադևոսյանին` ՀՀ քրեական օրենսգրքի 38-308-րդ հոդվածի 1-ին մասով, իսկ Ա. Հարությունյանին և Հ. Գրիգորյանին` ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով: Ա. Օհանյանն ու Գ. Թադևոսյանը կալանավորվել են: Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
