ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել պետական հատուկ ծառայություն իրականացնող անձի նկատմամբ սուտ մատնություն կատարելու դեպքի առթիվ:

Մասնավորապես, պաշտոնատար անձանց կաշառք տալու մեջ մեղադրվող, ամբաստանյալ  Ռուզաննա Բ.-ն, նախազգուշացված լինելով սուտ մատնության համար նախատեսված քրեական պատասխանատվության մասին, 09.11.2016թ.-ին կայացած դատական նիստի ժամանակ, իսկ այնուհետև Հատուկ քննչական ծառայությունում հաղորդում էր տվել այն մասին, որ իրեն տևական ժամանակ ապօրինի պահել են ոստիկանության ԿՀԴՊ գլխավոր վարչությունում և հոգեբանական ճնշման ու սպառնալիքների գործադրմամբ հարկադրել կեղծ հաղորդում տալ, որ 200.000 ՀՀ դրամի կաշառք է տվել ՀՀ գյուղատնտեսության նախարարության սննդի անվտանգության պետական ծառայության աշխատակիցներին: Միաժամանակ, Ռուզաննա Բ.-ն Հատուկ քննչական ծառայությանը հայտնել էր, որ 04.02.2016թ.-ին ՔԿ Երևան քաղաքի քննչական վարչությունում հարցաքննության ժամանակ քննիչ Գուրգեն Մ.-ի ուղղորդմամբ և թելադրանքով գրել է ոստիկանությունում տված հաղորդմանը նույնաբովանակ ցուցմունք:

Դեպքի առթիվ Հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 308-րդ և 309-րդ հոդվածի 1-ին մասերով հարուցված քրեական գործի նախաքննության ընթացքում պարզվել է, որ ոստիկանության հիշյալ վարչության աշխատակիցների կողմից Ռուզաննա Բ.-ին ապօրինի պահելու և իրականությանը չհամապատասխանող հաղորդում տալուն հարկադրելու վերաբերյալ բավարար ապացույցների համակցություն ձեռք չի բերվել, ուստի այդ մասով գործի վարույթը կարճվել է` հանցակազմի բացակայության հիմքով:

Ինչ վերաբերում է քննիչ Գուրգեն Մ.-ի կողմից ցուցմունք տալուն հարկադրելուն, ապա Ռուզաննա Բ.-ի տված ցուցմունքների զննությամբ պարզվել է, որ վերջինս քննիչի մոտ կաշառք տալու վերաբերյալ ոստիկանությունում տված հաղորդմանը նույնաբովանդակ ցուցմունք չի տվել, ավելին, հերքել է ՍԱՊԾ աշխատակիցներին կաշառք տալու հանգամանքը: Այսինքն` Գուրգեն Մ.-ն Ռուզաննա Բ.-ին չի ուղղորդել, չի թելադրել և չի հարկադրել գրել կաշառք տալու վերաբերյալ տրված հաղորդմանը նույնաբովանդակ ցուցմունք, ուստի որոշում է կայացվել քննիչի նկատմամբ քրեական հետապնդում չիրականացնել` նրա արարքում հանցադեպի բացակայության հիմքով:

Այսպիսով, Ռուզաննա Բ.-ն հանցագործության մասին գիտակցաբար կեղծ տեղեկություններ է տրամադրել նախաքննությունն իրականացնող մարմնին և կատարել սուտ մատնություն, որի համար Հատուկ քննչական ծառայությունում հարուցվել է քրեական գործ ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասով:                 

Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
