Դատապարտյալ Հրաչյա Գևորգյանի մահվան փաստի առթիվ դատախազի որոշմամբ հարուցվել է քրգործ

 2017թ. ապրիլի 5-ին՝ ժամը 18:00-ին, ՀՀ ԱՆ «Արմավիր» ՔԿՀ-ից  ՀՀ ոստիկանության Արմավիրի մարզային վարչության Վաղարշապատի բաժին ահազանգ է ստացվել այն մասին, որ նույն հիմնարկի դատապարտյալ Հրաչյա Հենզելի Գևորգյանը ՀՀ ԱՆ «Արմավիր» ՔԿՀ-ի բնակելի գոտու միջանցքում հանկարծամահ է եղել:

Հրաչյա Գևորգյանի մահվան փաստի առթիվ նախապատրաստված նյութերով պարզվել է, որ դատապարտյալը՝ «աստենո-նևրոտիկ սինդրոմ, էնցեֆալոպատիա, գլխուղեղի արյան շրջանառության սուր խանգարում» ախտորոշմամբ, 2017թ. մարտի 31-ին տեղափոխվել է նախ, ՀՀ ԱՆ «Դատապարտյալների հիվանդանոց»  ՔԿՀ, այնուհետև՝ «Սուրբ Գ.Լուսավորիչ» բժշկական կենտրոն, որտեղ վերջինիս մոտ ախտորոշվել են «հեպատիտ C», «լյարդ-բջջային անբավարարություն», «հոգեկան և վարքային խանգարումներ՝ կապված նարկոմանիայի հետ» հիվանդությունները: Ընդամենը մեկ օր անց՝ 2017թ. ապ րիլի 1-ին, «Սուրբ Գ.Լուսավորիչ» բժշկական կենտրոնից դատապարտյալը  դուրս է գրվել և կրկին տեղափոխվել ՀՀ ԱՆ «Դատապարտյալների հիվանդանոց»  ՔԿՀ:

2017թ. ապրիլի 1-ին դատապարտյալ Հրաչյա Գևորգյանը  «Դատապարտյալների հիվանդանոց»  ՔԿՀ-ում ենթարկվել է բուժզննության, որի արդյունքում նրա մոտ ախտորոշվել է «հոգեկան և վարքային խանգարումներ՝ նարկոմանիայի հետ կապված» հիվանդությունը, նշվել, որ ստացիոնար բուժման կարիք չունի և նրա մոտ նկատվում են «Ագրավացիայի» երևույթներ, որպիսի հիմնավորմամբ նույն օրը դատապարտյալը տեղափոխվել է ՀՀ ԱՆ «Արմավիր» ՔԿՀ, որտեղ 2017թ. ապրիլի 5-ին՝ ժամը 17:05-ին, մահացել է:

 Նկատի ունենալով այն, որ նյութերում առկա փաստական տվյալներն առերևույթ  հիմք են տալիս ենթադրելու, որ հնարավոր է դատապարտյալի մահն անզգուշությամբ առաջացած լինի բժշկական օգնություն եւ սպասարկում իրականացնողների կողմից մասնագիտական պարտականությունները չկատարելու կամ ոչ պատշաճ կատարելու` դրանց նկատմամբ անփույթ կամ անբարեխիղճ վերաբերմունքի հետեւանքով,  որպիսի հանգամանքը ենթակա է ստուգման  լրիվ, օբյեկտիվ և բազմակողմանի նախաքննությամբ, 2017թ. ապրիլի 7-ին Արմավիրի մարզի դատախազության դատախազի կողմից կայացվել է որոշում՝ Հրաչյա Գևորգյանի մահվան փաստի առթիվ նախապատրաստված նյութերով, ՀՀ քրեական օրենսգրքի 130-րդ հոդվածի 2-րդ մասի հատկանիշներով քրեական գործ հարուցելու մասին: Այս մասին տեղեկանում ենք ՀՀ դատախազության հանրային կապերի բաժնից:

Քրեական գործով լրիվ, օբյեկտիվ և բազմակողմանի քննությունը երաշխավորելու անհրաժեշտությամբ պայմանավորված՝ նախաքննությունը ՀՀ գլխավոր դատախազի կողմից հանձնարարվել է ՀՀ հատուկ քննչական ծառայությանը: 

Ինչ վերաբերում է ԶԼՄ-ներով դատապարտյալի պաշտպանի և իրավապաշտպան կազմակերպությունների ներկայացուցիչների հրապարակած  այն տեղեկություններին, թե նախկինում Հրաչյա Գևորգյանը նշել  է «Դատապարտյալների հիվանդանոց» ՔԿՀ-ում իրեն թունավորելու մասին, ապա հայտնվում է, որ ՀՀ գլխավոր դատախազին հասցեագրված՝ որդու առողջական վիճակը վատթարացնելու, նրան պատշաճ բժշկական օգնություն չցուցաբերելու վերաբերյալ դատապարտյալի մոր դիմումների կապակցությամբ նախապատրաստված նյութերով դեռևս 2016թ. մարտի 22-ին Երևան քաղաքի դատախազի կողմից կայացվել է որ ոշում՝ նյութերով քրեական գործ հարուցելը մերժելու մասին հետաքննության մարմնի 2016թ. փետրվարի 26-ի որոշումը վերացնելու և ՀՀ քրեական օրենսգրքի 130-րդ հոդվածի 1-ին մասի հատկանիշներով քրեական գործ հարուցելու մասին: ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Կենտրոն և Նորք-Մարաշ վարչական շրջանների քննչական բաժնի վարույթում քննվող այդ քրեական գործով էական նշանակություն ունեցող մի շարք հանգամանքներ պարզելու համար 2016թ. սեպտեմբերի 13-ին նշանակվել է հանձնաժողովային դատաբժշկական փորձաքննություն: Քրեական գործով նախաքննությունը շարունակվում է:
