ՀՀ քննչական կոմիտեի ԶՔԳՎ 9-րդ կայազորային քննչական բաժնում ավարտվել է ՀՀ ԱԱԾ սահմանապահ զորքերի N զորամասի պարտադիր ժամկետային զինծառայող, շարքային Գևորգ Խաչատրյանի մահվան դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:

2015թ. նոյեմբերի 28-ին ՀՀ քննչական կոմիտեի ԶՔԳՎ 9-րդ կայազորային քննչական բաժնում ահազանգ էր ստացվել առ այն, որ նույն օրը՝ ժամը 22:50-ի սահմաններում, սահմանապահ ուղեկալի պարտադիր ժամկետային զինծառայող, շարքային Գևորգ Խաչատրյանը, լինելով պետական սահմանի պահպանության սահմանապահ վերակարգի կազմի մեջ, ստացել է հրազենային վնասվածք և տեղափոխվել զորամասի բուժկետ։ Պարզվել է, որ Գ.Խաչատրյանը կզակի շրջանի հրազենային վնասվածքն ստացել է իրեն ամրակցված ԱԿ-74 147 9229 համարի ինքնաձիգով, և բուժկետում գրանցվել է նրա բիոլոգիական մահը:

Իրականացված մեծածավալ քննչական գործողությունների արդյունքում բավարար ապացույցներ են ձեռք բերվել առ այն, որ 2015թ. նոյեմբերի 27-ին՝ ժամը 18:30-ի սահմաններում, զորամասի սահմանապահ ուղեկալի պարտադիր ժամկետային զինծառայող, շարքային Գ.Խաչատրյանը, շարքային Հ. Մուրադյանի, ուղեկալի ավագ, ենթասպա Հ. Քալաշյանի և ուղեկալի պետ, կապիտան Մ.Ոսկանյանի հետ մասնակցել են վերջինիս կազմակերպած «Բլոտ» մոլեխաղին։

Ըստ ձեռք բերված պայմանավորվածության՝ հաղթելու դեպքում շարքային շինծառայողները մեկ օրով պետք է ազատվեին ծառայողական պարտականությունների կատարումից, իսկ պարտվելու դեպքում՝ յուրաքանչյուրը 7 օր ճաշարանից կերակրի ավելցուկը դույլերով պետք է տեղափոխեր ուղեկալի տեղակայման վայրից մոտ 150 մետր հեռավորության վրա գտնվող անասնագոմ՝ Մ.Ոսկանյանին և Հ.Քալաշյանին պատկանող խոզերին կերակրելու նպատակով։ Քննությամբ պարզվել է, որ շարքայինները պարտվել են և սկսել կատարել պայմանը:

Հաջորդ օրը՝ 2015թ. նոյեմբերի 28-ին՝ ժամը 20:00-ից 21:00-ն ընկած ժամանակահատվածում, ուղեկալի տարածքում շարքային Հ.Մուրադյանը բռնի գործողություններ է կատարել Գ. Խաչատրյանի նկատմամբ, անհիմն կշտամբել և հեգնել, վիրավորել, ձեռքերով և ոտքով բազմաթիվ հարվածներ հասցրել նրա մարմնի տարբեր հատվածներին:

Քննությամբ ձեռք բերված տվյալների համաձայն՝ այսօրինակ վիրավորանքներից հետո Գ.Խաչատրյանը գնացել է լվացվելու, ստացել իրեն ամրակցված ԱԿ-74 տեսակի ինքնաձիգն ու 50 հատ 5,45մմ տրամաչափի փամփուշտ՝ երկու փամփշտատուփերում։

Համապատասխան հրահանգավորումն ստանալուց հետո պարտադիր ժամկետային զինծառայող, շարքային Ա.Անտոնյանի հետ  Գ.Խաչատրյանն ուղևորվել է սահմանի վերակարգի ծառայություն կրելու կատարման վայր, որտեղ կատարել է մի քանի հեռախոսազանգ, ապա բջջային հեռախոսը փոխանցել Ա.Անտոնյանին և բնական կարիքները հոգալու պատրվակով շուրջ 50 մետր հեռացել նրանից։ Որոշ ժամանակ անց՝ ինքնաձիգից մենահատ կրակոց կատարելու եղանակով կատարել է ինքնասպանություն:

Մինչդատական  վարույթում ձեռք բերված բավարար ապացույցների համակցությամբ՝ Հ.Մուրադյանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 364.1-րդ հոդվածի 1-ին մասով (զինծառայողի կողմից մոլեխաղեր կազմակերպելը կամ դրանց մասնակցելը) (2 դրվագ), 359-րդ հոդվածի 2-րդ մասի 2-րդ կետով, 359-րդ հոդվածի 3-րդ մասով  (զինծառայողների փոխհարաբերությունների կանոնագրքային կանոնները խախտելը՝ նրանց միջև ստորադասության (ենթակայության) հարաբերությունների բացակայության դեպքում),  Մ.Ոսկանյանին՝ ՀՀ քրեական օրենսգրքի 364.1-րդ հոդվածի 2-րդ մասով, 375-րդ  հոդվածի 1-ին մասով (իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը), 360-րդ հոդվածի 2-րդ մասով (զինծառայողին վիրավորանք հասցնելը), Հ.Քալաշյանին՝ ՀՀ քրեական օրենսգրքի 364.1-րդ հոդվածի 1-ին մասով և 375-րդ  հոդվածի 1-ին մասով:

Երեք մեղադրյալների մասով  գործն անջատվել է առանձին վարույթ, հայտարարվել նախաքննության ավարտի մասին և մեղադրական եզրակացությամբ ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին։
