ԴԱՀԿ ծառայության աշխատակիցների կողմից չարաշահումներ կատարելու փաստերով քրգործեր են հարուցվել

ՀՀ հատուկ քննչական ծառայությունում քրեական գործեր են քննվում ՀՀ ԱՆ ԴԱՀԿ ծառայության տարբեր ստորաբաժանումների աշխատակիցների կողմից կատարված ենթադրյալ չարաշահումների փաստերով: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Այսպես, Երևան քաղաքի բնակչուհի Ս. Ս.-ն ՀՀ ոստիկանությունում հաղորդում է տվել, որ ՀՀ ԱՆ ԴԱՀԿ ծառայության Էրեբունի և Նուբարաշեն վարչական շրջանները սպասարկող ստորաբաժանման հարկադիր կատարող Ա. Բ.-ն, կատարողական վարույթի շրջանակներում, ուղղակի վաճառքով 8 հատ գույք իրացնելու որոշում է կայացրել: Ս. Ս.-ն գնել է նշված գույքից երկուսը, որոնց համար հարկադիր կատարող Ա. Բ.-ին վճարել է համապատասխան գումար, սակայն գնված գույքն իրեն ներկայացնելու ժամանակ նկատել է, որ դրանք վնասված են, որից հետո տվյալ գործարքն անվավեր ճանաչելու հայցով դիմել է դատարան:  Արդյունքում` ՀՀ վարչական վերաքննիչ դատարանի` 21.03.2017թ.-ին կայացրած որոշմամբ, գործարքն անվավեր ճանաչելու վերաբերյալ բողոքը բավարարվել է, սակայն հարկադիր կատարող Ա. Բ.-ն այդպես էլ չի կատարել դատական ակտի պահանջները:

Դեպքի առթիվ ՀՀ ոստիկանության Մաշտոցի բաժնում հարուցված քրեական գործ` ՀՀ քրեական օրենսգրքի 353-րդ հոդվածի 1-ին մասով: Հաշվի առնելով, որ քրեական գործի նյութերում առկա են պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից կատարված առերևույթ հանցագործության հատկանիշներ, նշված քրեական գործն ըստ քննչական ենթակայության ընդունվել է ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ` հետագա նախաքննությունը կատարելու համար:

Եվս մեկ քրեական գործ էլ հարուցվել է ՀՀ ԱՆ ԴԱՀԿ ծառայության Կոտայքի մարզային բաժնի աշխատակցի կողմից պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ նախապատրաստված նյութերի հիման վրա:

Այսպես, քրեական գործի նյութերով տվյալներ են ձեռք բերվել, որ ԴԱՀԿ ծառայության Կոտայքի մարզային բաժնի ավագ հարկադիր կատարող Կ. Հ.-ն դատարանի կողմից տրված կատարողական թերթի հիման վրա արգելանք է դրել պարտապան Է. Ա.-ի դրամական միջոցների վրա: Սակայն որոշ ժամանակ անց, անտեսելով «Դատական ակտերի հարկադիր կատարման մասին» ՀՀ օրենքով նախատեսված` պարտապանի գույքն արգելանքից հանելու հիմքերն ու կարգը, որոշում է կայացրել Է. Ա.-ի` բանկում գտնվող դրամական միջոցներն ամբողջությամբ արգելանքից ազատելու մասին:

Այսպիսով, ԴԱՀԿ ծառայության պետական հատուկ ծառայություն իրականացնող անձի կողմից պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 1-ին մասով:

Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
