ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ է ընդունվել ՀՀ ոստիկանության պաշտոնատար անձի կողմից պաշտոնեական դիրքի չարաշահման դեպքի առթիվ ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում հարուցված քրեական գործը:

Ինչպես տեղեկացանք ՀՔԾ-ից,  ապօրինի ծառահատումների վերաբերյալ ՀՀ քննչական կոմիտեում քննվող քրեական գործի նախաքննության ընթացքում տվյալներ են ձեռք բերվել ՀՀ ոստիկանության Դիլիջանի բաժնի ավագ հետաքննիչի կողմից կատարված առերևույթ հանցագործության` պաշտոնեական դիրքը չարաշահելու վերաբերյալ: Ըստ քրեական գործի նյութերի` ապօրինի ծառահատումների վերաբերյալ նյութերի նախապատրաստման ընթացքում ոստիկանության հիշյալ պաշտոնյան Հաղարծին գյուղի բնակչից բացատրություն վերցնելու վերաբերյալ արձանագրություն է կազմել Դիլիջան քաղաքի բնակչուհի Ս. Ասլանյանի մասնակցությամբ, սակայն վերջինս քրեական գործի նախաքննության ընթացքում ցուցմունքներ է տվել, որ նշված գործողությանը չի մասնակցել:

Բացի այդ, Տավուշի մարզի ևս մեկ բնակիչ` Է. Սահակյանը, նախաքննության ընթացքում հայտնել է, որ իր տան բակում հայտնաբերված փայտանյութի ծագման աղբյուրը պարզելու նպատակով նույն պաշտոնյայի` Դիլիջանի բաժնի հետաքննիչի հետ այցելել է «Դիլիջան ազգային պարկ» ՊՈԱԿ-ի «Հաղարծին» տեղամաս, որտեղ ոստիկանության աշխատակիցն իրեն ուղղորդել է մատնացույց անել, իբր, իր կողմից ապօրինի հատված ծառերը, սակայն իրականում դրանք իր կողմից չեն հատվել: Այսինքն, ըստ Է. Սահակյանի, զննման հիշյալ գործողությունը ձևական բնույթ է կրել և ուղղորդվել է հետաքննիչի կողմից: Ավելին` զննության և իր կողմից տրված բացատրության արձանագրություններում առկա տեղեկություններն իրականությանը չեն համապատասխանում:

Նույնաբովանդակ ցուցմունքներ է տվել նվել նաև Է. Սահակյանի որդին:

Վերը նշված դեպքի առթիվ ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով: Հաշվի առնելով, որ քրեական գործի նյութերում առկա են ՀՀ ոստիկանության պետական հատուկ ծառայություն պաշտոնատար անձի կողմից կատարված առերևույթ հանցագործության հատկանիշներ, նշված քրեական գործն ըստ քննչական ենթակայության ընդունվել է ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ` հետագա նախաքննությունը կատարելու համար: 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեականդատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
