Խորհրդարանն առաջին ընթերցմամբ ընդունեց «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի նախագիծը

Ազգային ժողովն առաջին ընթերցմամբ ընդունեց «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի նախագիծը: Ինչպես հաղորդում է «Արմենպրես»-ը, նախագծին կողմ քվեարկեցին 89, դեմ՝ 9 պատգամավոր:

Քվեարկությունից առաջ նախագծին դեմ քվեարկելու մասին հայտարարեց «Ելք» խմբակցությունը:

Նախագծի ընդունումը հետապնդում է երեք հիմնական նպատակ` սահմանադրական բարեփոխումների գործադրման իրավական հիմքի ապահովում, ոլորտը կարգավորող օրենքների կոնսոլիդացում և նոր քաղաքականությունների ներդրում, այդ թվում` «Պատիվ ունեմ» և «Ես եմ» ծրագրերի իրականացումն ապահովելու իրավական դաշտի ստեղծում:

Օրենքի նախագիծը ներառում է պաշտպանության ոլորտի քաղաքականության այսօր գործող երեք օրենք. «Զինապարտության մասին» օրենքը, «Զինծառայողների և նրանց ընտանիքի անդամների սոցիալական ապահովման մասին» օրենքը և «Զինվորական ծառայություն անցնելու մասին» օրենքը: Օրենքը կարգավորում է Հայաստանի Հանրապետության պաշտպանությանը մասնակցելու, սահմանադրական պարտականության շրջանակում քաղաքացիների զինվորական ծառայության նախապատրաստության, զինվորական ծառայության և պահեստազորային պատրաստականության կազմակերպման և իրականացման, ինչպես նաև զինծառայողների, նրանց ընտանիքների անդամների ու զինծառայողներին հավասարեցված անձանց իրավական և սոցիալական երաշխիքների հետ կապված հարաբերությունները:

Օրենքի նախագծի ընդունմամբ ակնկալվում է ապահովել խաղաղ և պատերազմի ժամանակ Հայաստանի Հանրապետության զինված պաշտպանության արդյունավետությունը, բարձրացնել քաղաքացիների վստահությունը պարտադիր զինվորական ծառայության և պահեստազորային պատրաստության գործընթացի նկատմամբ, քաղաքացիների մոտ խթանել պարտադիր և պայմանագրային զինվորական ծառայություն անցնելու կամարտահայտման դրսևորումը, նպաստել «Ազգ-բանակ» գաղափարախոսության ամբողջական իրացմանը:

«Զինվորական ծառայություն անցնելու մասին» ՀՀ օրենքով սահմանվում են զինվորական ծառայության տեսակները` պայմանագրային, պարտադիր և պահեստազորային, սակայն հիմնական կարգավորում տրվում է պայմանագրային զինծառայություն անցնելու հարաբերություններին, իսկ զորակոչի միջոցով իրականացվող պարտադիր զինվորական ծառայության և պահեստազորում ծառայության հետ կապված հարաբերությունները գրեթե կարգավորված չեն: Գործող «Զինծառայողների և նրանց ընտանիքների անդամների սոցիալական ապահովության մասին» ՀՀ օրենքով սահմանվող հարաբերություններն ընդգրկում են զինվորական ծառայության մեջ գտնվող անձանց, նրանց ընտանիքների անդամների և նրանց հավասարեցված անձանց իրավական և սոցիալական երաշխիքները, որոնք առանձին օրենքի տեսքով կարգավորելու անհրաժեշտությունն արդեն իսկ արդիական չէ: Արդյունքում, ժամանակի հրամայական է դարձել վերը նշված օրենքներով կարգավորվող հարաբերությունները սահմանել նորովի և մեկ միասնական օրենքի տեսքով:
