ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ է ընդունվել ՀՀ ոստիկանության պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից ծառայողական պարտականությունները չկատարելու և պետության օրինական շահերին վնաս պատճառելու առերևույթ հանցագործության դեպքի առթիվ ՀՀ գլխավոր դատախազությունում հարուցված քրեական գործը: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Հետախուզման մեջ գտնվող, քրեական գործով մեղադրյալ Գ. Պետրոսյանը 24.10.2016թ.-ին ՀՀ մուտք գործելիս հայտնաբերվել է ոստիկանության Բագրատաշենի բաժանմունքի աշխատակիցների կողմից և նույն օրը ներկայացվել ոստիկանության Նաիրիի բաժնի քրեական հետախուզության բաժանմունքի օպերլիազորին: Վերջինս, սակայն, պարտավոր լինելով հետախուզվող անձին ներկայացնել վարույթն իրականացնող մարմնին, որևէ գործողություն չի ձեռնարկել այդ ուղղությամբ և քննիչին չի տեղեկացրել հետախուզվողի հայտնաբերման մասին: Ոստիկանության օպերլիազորը նույն օրը հետախուզումը դադարեցնելու և հետախուզական գործը կարճելու մասին որոշում է ուղարկել ոստիկանության ինֆորմացիոն կենտրոն, որտեղ հետախուզական գործը հաշվառումից հանվել է, մինչդեռ Գ. Պետրոսյանի վերաբերյալ քրեական գործով  վարույթը շարունակել է մնալ կասեցված` մեղադրյալի գտնվելու վայրը հայտնի չլինելու հիմքով:

Հիշյալ դեպքի առթիվ ՀՀ գլխավոր դատախազությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով: Հաշվի առնելով, որ քրեական գործի նյութերում առկա են ՀՀ ոստիկանության պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից անձնական շահագրգռվածությունից ելնելով ծառայողական պարտականությունները չկատարելու և պետության օրինական շահերին վնաս պատճառելու  առերևույթ հանցագործության հատկանիշներ, նշված քրեական գործն ըստ քննչական ենթակայության ընդունվել է ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ` հետագա նախաքննությունը կատարելու համար:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
