ՀՀ հատուկ քննչական ծառայությունում քննված  քրեական գործի նախաքննության ընթացքում ձեռք բերված բավարար ապացույցներով հիմնավորվել է, որ 05.11.2017թ.-ին կայացած տեղական ինքնակառավարման մարմինների ընտրությունների ժամանակ ՀՀ քաղաքացի Պետրոս Էլբակյանը խոչընդոտել է «ՑԱՅԳ» հեռուստաընկերության ներկայացուցչի լիազորությունների իրականացմանը: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Այսպես, հիշյալ լրատվամիջոցի ներկայացուցիչներ Արթուր Մարգարյանն ու Ալլա Բաղդասարյանը, ընտրությունների ընթացքը լուսաբանելու նպատակով, 2017թ. նոյեմբերի 5-ին գնացել են Շիրակի մարզի Մարմաշեն գյուղի միջնակարգ դպրոցում տեղակայված թիվ 30/08 ընտրատեղամաս: Տեսանյութն առավել ամբողջական դարձնելու համար օպերատոր Ա. Մարգարյանը տեսախցիկով սկսել է տեսանկարահանել ընտրատեղամասի բակը և այնտեղ հավաքված քաղաքացիներին: Այդ ընթացքում ընտրատեղամասից դուրս է եկել Մարմաշեն գյուղի բնակիչ Պետրոս Էլբակյանը, ով նկատելով ընտրությունների ընթացքը նշված տարածքում լուսաբանող «ՑԱՅԳ»  հեռուստաընկերության օպերատոր Ա. Մարգարյանին` մոտեցել է վերջինիս և պահանջել դադարեցնել տեսանկարահանումը, այն դեպքում, երբ օպերատորը մինչ այդ տեսախցիկը նրա ուղղությամբ չէր պահել: Ա. Մարգարյանը շարունակել է իրականացնել իր լիազորությունները, որի ընթացքում Պ. Էլբակյանը, տեսանկարահանմանը խոչընդոտելու դիտավորությամբ, ձեռքով մի կողմ է հրել տեսախցիկը` այդ կերպ խոչընդոտելով ընտրությունների ընթացքը լուսաբանելու Ա. Մարգարյանի լիազորությունները:

Այսպիսով, տեղական ինքնակառավարման մարմինների ընտրությունների ժամանակ ՑԱՅԳ հեռուստաընկերության ներկայացուցչի լիազորությունների իրականացմանը խոչընդոտելու համար Պետրոս Էլբակյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 149-րդ հոդվածի 1-ին մասով:

Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
