Մեղադրական եզրակացությամբ ավարտվել է կաշառք տալու փաստով քննված ևս մեկ քրեական գործի նախաքննություն

 Կաշառք տալու և փաստաբանի կողմից կաշառքի դրդչության փաստերով ՀՀ հատուկ քննչական ծառայությունում քննված քրեական գործի նախաքննությամբ հիմնավորվել է, որ փաստաբան Վաղինակ Աթոյանը, խաբեությամբ զգալի չափերով ուրիշի գույքի հափշտակություն կատարելու դիտավորությամբ, Մանուկ և Սեդա Մանուկյաններին դրդել է հանցավոր արարքի կատարման` պաշտոնատար անձանց խոշոր չափերով կաշառք տալուն: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Այսպես, հիշյալ քրեական գործի նախաքննությամբ պարզվել է, որ 03.10.2017թ.-ին կայացված դատավճռով ամբաստանյալ, ՀՀ ԱՆ «Նուբարաշեն» քրեակատարողական հիմնարկի կալանավոր Մանուկ Մանուկյանի նկատմամբ նշանակված 3 տարի ժամկետով ազատազրկման ձևով պատիժը փոփոխվել և նշանակվել է ավելի մեղմ պատիժ՝ 2 տարի ժամկետով ազատազրկում: Օգտվելով ստեղծված բարենպաստ պայմաններից` ամբաստանյալի շահերի պաշտպանը` ՀՀ փաստաբանների պալատի փաստաբան Վաղինակ Աթոյանը, դատարանի հիշյալ որոշմամբ կատարված դրական փոփոխություններն իրեն վերագրելու և խաբեությամբ զգալի չափերով հափշտակություն կատարելու դիտավորությամբ, ՀՀ ԱՆ Նուբարաշեն ՔԿՀ-ում տեսակցել է Մ. Մանուկյանին: Վ. Աթոյանը ինչպես Մ. Մանուկյանին, այնպես էլ հետագայում նրա քրոջը՝ Սեդա Մանուկյանին իրականությանը չհամապատասխանող տեղեկություններով հավաստիացրել է, թե, իբր, դատավորները ամբաստանյալի օգտին գործողությունները կատարել են կաշառքի դիմաց, որից հետո փաստաբանը համոզելու եղանակով դրդել է տալ 470.000 ՀՀ դրամ կաշառք` այն, իբր, դատավորներին փոխանցելու համար: Մանուկ և Սեդա Մանուկյանները տվել են իրենց համաձայնությունը, ապա` 2017 թվականի հոկտեմբերի 4-ին Վ. Աթոյանը Ս. Մանուկյանից անձամբ ստացել է հիշյալ 470.000 ՀՀ դրամը: Սակայն արդյունքում` Մանուկ և Սեդա Մանուկյանների կողմից պաշտոնատար անձանց խոշոր չափերով կաշառք տալը ավարտին չի հասցվել իրենց կամքից անկախ հանգամանքներով, քանի որ փաստաբանը հանցանք կատարելու դրդմամբ ստացած հիշյալ գումարն ի սկզբանե դատավորներին փոխանցելու մտադրություն չի ունեցել և այն խաբեությամբ հափշտակել է:

Այսպիսով, պաշտոնատար անձանց խոշոր չափերով կաշառք տալու փորձի համար Մանուկ և Սեդա Մանուկյաններին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 34-312-րդ հոդվածի 2-րդ մասով, իսկ փաստաբան Վ. Աթոյանին` խոշոր չափերով կաշառք տալու փորձի դրդչության համար մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 38-34-312-րդ հոդվածի 2-րդ մասով:

Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:                                                                                                                                                                   

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
