ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործով ձեռք բերված բավարար ապացույցներով պարզվել է, որ ՀՀ քննչական կոմիտեի Երեւան քաղաքի քննչական վարչության Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների քննչական բաժնի քննիչ Ռաֆիկ Կարապետյանն իր վարույթում քննվող` բռնությամբ զուգորդված խուլիգանության դեպքի վերաբերյալ քրեական գործով ապացույցներ է կեղծել:

ՀՔԾ-ից հայտնում են, որ Ռ. Կարապետյանը 27.10.2017թ.-ին վարույթ է ընդունել Երեւանում գործող Մոսքոու դիսկո ակումբում 16.10.2017թ.-ին մի խումբ անձանց կողմից բռնությամբ զուգորդված խուլիգանություն կատարելու վերաբերյալ ՀՀ քրեական օրենսգրքի 258-րդ հոդվածի 3-րդ մասի 1-ին կետով հարուցված քրեական գործը, որի նախաքննության ընթացքում միջադեպի մասնակիցները` Հովհաննես Աղաքարյանը, Անդրանիկ Փարվանյանը եւ Սվետլանա Իբրաջյանը հարցաքննվել են որպես վկաներ եւ ցուցմունքներ տվել նշված ակումբում իրենց միջեւ տեղի ունեցած վիճաբանության ընթացքում փոխադարձ հայհոյանքներ տալու եւ միմյանց հարվածներ հասցնելու մասին:

Քննիչ Ռ. Կարապետյանը, գիտակցելով, որ նման պայմաններում վերը նշված երեք անձանց արարքները քրեորեն պատժելի են, ցանկացել է կարճել քրեական գործի վարույթը եւ վերջիններիս քրեական պատասխանատվության չենթարկել: Այդ նպատակով քննիչը վկաներից Ս. Իբրաջյանին հայտնել է, որ եթե վերջինս փոխի իր նախկին ցուցմունքը` հերքի վիճաբանության ընթացքում հայհոյանքներ տալու եւ փոխադարձ հարվածներ հասցնելու հանգամանքները, ապա կարող է ազատվել քրեական պատասխանատվությունից:

Միաժամանակ քննիչը Ս. Իբրաջյանին  հավաստիացրել է, որ վիճաբանության մյուս կողմը նույնպես փոխելու է ցուցմունքները:

Ստանալով Ս. Իբրաջյանի համաձայնությունը` Ռ. Կարապետյանը վերջինիս անվամբ լրացրել է քրեական գործով ապացույց հանդիսացող` նրա ցուցմունքի բովանդակությամբ լրացուցիչ հարցաքննության մասին արձանագրություն, որում մտցրել է իրականությանը չհամապատասխանող տեղեկություններ, որ Ս. Իբրաջյանը, գտնվելով ալկոհոլի ազդեցության տակ, դեպքի հանգամանքները ճիշտ չի ընկալել, վիճաբանության ընթացքում հայհոյանքներ չեն հնչել ու կողմերն իրար չեն հարվածել:

Այնուհետեւ, շարունակելով ապացույցներ կեղծելու ճանապարհով հիշյալ անձանց քրեական պատասխանատվությունից ազատելուն միտված իր գործողությունները` քննիչ Ռ. Կարապետյանը վիճաբանության մյուս կողմին` Հ. Աղաքարյանին եւ Ա. Փարվանյանին ներկայացրել է, որ Ս. Իբրաջյանն արդեն փոխել է իր ցուցմունքը` հերքելով վիճաբանության ընթացքում հայհոյանքներ տալու եւ միմյանց հարվածելու հանգամանքները եւ առաջարկել է, որ վերջիններս էլ նույնաբովանդակ ցուցմունքներ տան:

Ստանալով Հ. Աղաքարյանի եւ Ա. Փարվանյանի համաձայնությունը` Ռ. Կարապետյանը վերջիններիս անվամբ լրացրել է նրանց ցուցմունքների բովանդակությամբ լրացուցիչ հարցաքննության մասին արձանագրություններ, որոնցում մտցրել է կեղծ տեղեկություններ, որ վիճաբանության ընթացքում հայհոյանքներ չեն հնչել ու կողմերն իրար չեն հարվածել:

Այսպիսով, վերը նշված հանցավոր արարքները կատարելու` քրեական գործով ապացույցներ կեղծելու համար քննիչ Ռ. Կարապետյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 349-րդ հոդվածի 2-րդ մասով:

Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվելու է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու եւ դատարան ուղարկելու համար:
