Բարձրագույն դատական խորհուրդը հանդիպել է Երևանի ընդհանուր իրավասության դատարանի դատավորների հետ

Բարձրագույն դատական խորհրդի և  Երևան քաղաքի ընդհանուր իրավասության դատարանի դատավորների միջև մայիսի 21-ին տեղի ունեցավ աշխատանքային  հանդիպում:

ԲԴԽ նախագահը դատավորներին ներկայացրեց Բարձրագույն դատական խորհրդի ձեռնարկած հիմնական քայլերը, ծրագրային մոտեցումները, առաջիկա գործողու­թյունների ժամանակացույցը, ինչը բխում է «Հայաստանի Հանրապետության դատա­կան օրենսգիրք» սահմանադրական օրենքի պահանջներից: Կարևորվեց որ, Օրենս­գրքով կան հստակ սահ­մանված ժամկետներ, որոնց պահպանումը պարտադիր է: Դա վերաբերում է ոչ միայն անհրաժեշտ իրավական ակտերի նախապատ­րաստմանն ու ընդունմանը, այլև վեցամսյա ժամկետում դատարանների նախա­գահների նշանակ­մանը, կառուցակարգային բազմաթիվ խնդիրների լուծմանը: Այս մասին տեղեկացրին ՀՀ դատական դեպարտամենտի Արարողակարգի և հասարակայնության հետ կապերի վարչությունից:

Խորհրդի նախագահն առանձնակի կարևորեց Բարձրագույն դատական խորհրդի 2018թ. ապրիլի 12-ի որոշման հետևողական իրացումը, որում մասնավորապես շեշտվել է. «Անթույլատրելի համարել դատավորի գործունեությանը որևէ միջամտություն, այդ թվում՝ կոնկրետ գործի քննության առնչությամբ հանրային իշխանության ցանկացած ներկայացուցչի հեռախոսային կամ այլ բնույթի հաղորդակցությունը գործը քննող դատավորի կամ դատարանի նախագահի հետ, ինչպես նաև այդ առնչությամբ հրապարակային հայտարարություն անելը՝դա համարելով միջամ­տություն դատավորի գործունեությանը և դատարանի անկախությանը»:

Գոհունակություն հայտնվեց, որ այս հարցում առկա է նաև երկրի քաղաքական իշխանությունների հստակ դիրքորոշումը՝ բացառել որևէ միջամտություն արդարադատական գործընթացին և ակնկալել երկրում ունենալ անկախ ու միաժամանակ օրենքի առջև պատասխանատու դատարաններ:

Բարձրագույն դատական խորհրդի նախագահը ներկայացրեց նաև առկա մի շարք խնդիրների լուծման առնչությամբ Խորհրդի կոնկրետ մոտեցումները:

Առանձին հարցերի առնչությամբ դիրքորոշումներ արտահայտեցին նաև հանդիպման մասնակիցները՝ կարևորելով նման հանդիպումների անհրաժեշտությունը:

Հանդիպմանը մասնակցում էին Երևան քաղաքի ընդհանուր իրավասության դատարանի գործող 64 դատավորներից 60-ը, երեքը հերթապահություն էին իրականացնում, մեկ դատավոր բացակայում էր հարգելի պատճառով:
