«Մարդու իրավունքների պաշտպանի մասին» ՀՀ սահմանադրական օրենքում փոփոխությունների նախագծով առաջարկվում է ՄԻՊ-ին իրավահավասարության խորհուրդ ստեղծելու իրավունք տալ: Այս մասին, այսօր՝ հունիսի 6-ին, ԱԺ պետական-իրավական եւ մարդու իրավունքների պաշտպանության հարցերի հանձնաժողովում հիշյալ օրինագծի երկրորդ ընթերցումից առաջ քննարկման ժամանակ նշեց Արդարադատության նախարարի առաջին տեղակալ Արթուր Հովհաննիսյանը: Նա նշեց, որ այդ խորհուրդը գործելու է հասարակական հիմունքներով:

Հանձնաժողովի նախագահ Գեւորգ Կոստանյանը նշեց, որ եթե դա բյուջեի համար ծախսեր չի առաջացնում, կարելի է ցանկացած խորհրդակցական մարմին ստեղծել:

Պետաիրավական հարցերի հանձնաժողովի փոխնախագահ Ռուստամ Մախմուդյանն էլ նկատեց, որ Կառավարությունը շրջանառության մեջ է դրել ազգային փոքրամասնությունների իրավունքների, նաեւ իրավահավասարության մասին օրենքի նախագիծը եւ ճիշտ կլիներ, որ այդտեղ բոլոր հարցերը կարգավորել: Նա առաջարկեց այդ դրույթը հանել օրինագծից եւ ընդունել օրինագիծն առանց դրա: Հանձնաժողովը առանց այդ փոփոխության կողմ քվեարկեց օրինագծին:

Նշենք, որ «Մարդու իրավունքների պաշտպանի մասին» օրենքի այս փոփոխություններով առաջարկվում է, որ այլ անձի իրավունքների եւ ազատությունների պաշտպանության նպատակով Պաշտպանին կարող են դիմել այդ անձի ներկայացուցիչը, նրա իրավահաջորդը, ժառանգը, խնամակալության եւ հոգաբարձության մարմինները` երեխաների, անգործունակ եւ սահմանափակ գործունակ անձանց, ինչպես նաեւ ազատությունից զրկված անձանց եւ զինծառայողների մերձավոր ազգականները` նրանց իրավունքների պաշտպանության նպատակով»:

Մեկ այդ հոդվածով նշվում է, որ ՄԻՊ-ի կողմից բողոքը չի քննարկվում, իսկ բողոքի կապակցությամբ սկսված քննարկումը դադարեցվում է նաեւ այն դեպքում, երբ բողոքի ուսումնասիրության կամ քննարկման ընթացքում բարձրացված հարցը ստացել է լուծում, անձը դրանում բարձրացված նույն հարցով դիմել է դատարան, բողոք ներկայացրած անձն այն անհետեւանք թողնելու կամ բողոքի քննարկումը դադարեցնելու խնդրանքով դիմել է Պաշտպանին, առկա է նույն հարցի վերաբերյալ դատարանի վերջնական դատական ակտ, կամ այն անձը, ում իրավունքների ենթադրյալ խախտմանն առնչվել է բողոքը, մահացել է կամ օրինական ուժի մեջ է մտել նրան անհայտ բացակայող կամ մահացած ճանաչելու վերաբերյալ դատարանի վճիռը:»
