Եթե նախաքննություն կատարելիս ծագում է մեղադրանքը փոփոխելու կամ լրացնելու անհրաժեշտություն՝ քննիչը՝ ի տարբերություն գործող օրենքի, պարտավոր է կրկին մեղադրանք առաջադրել: Այս մասին, այսօր՝ հունիսի 6-ին, ԱԺ պետական-իրավական եւ մարդու իրավունքների պաշտպանության հարցերի հանձնաժողովում «ՀՀ քրեական դատավարության օրենսգրքում փոփոխություններ կատարելու մասին» օրենքի նախագծի քննարկման ժամանակ նշեց օրինագիծը ներկայացնող արդարադատության նախարարի առաջին տեղակալ Արթուր Հովհաննիսյանը:

Նրա խոսքով, եթե նախաքննության ընթացքում առաջադրված մեղադրանքի որեւէ մասը չի հաստատվում, քննիչն իր որոշմամբ առաջադրված մեղադրանքի այդ մասը վերացնում է եւ այդ մասին հայտարարում մեղադրյալին:

«Այսինքն՝ վերոհիշյալ դրույթների տառացի մեկնաբանությունը վկայում է, որ քրեական դատավարության օրենսգիրքը նախատեսվում է միայն առաջադրված մեղադրանքը փոփոխելու կամ լրացնելու հնարավորություն:

«Այնինչ, հնարավոր են այնպիսի իրավիճակներ, երբ որպես մեղադրյալ ներգրավված անձի առնչությամբ քննվող գործով ի հայտ գան այնպիսի փաստական տվյալներ, որոնք հիմք տան մեղադրանքը փոփոխելու կամ լրացնելու համար, այդ թվում՝ մեղմացման առումով, սակայն անձին մեղադրանք առաջադրված չլինի՝ վերջինիս հետախուզման մեջ գտնվելու պատճառով: Այս դեպքում ՀՀ քրեական դատավարության օրենսգրքի 204-րդ հոդվածով սահմանված կարգով համապատասխան որոշումներ կայացնելու հնարավորության հարցը, առկա օրենսդրական ձեւակերպումների պայմաններում, խիստ վիճելի է եւ կարող է տարաբնույթ մեկնաբանությունների տեղիք տալ»,-ասաց փոխնախարարը:

Այսպիսով, ըստ նրա, ստացվում է, որ քննիչի եւ հետաքննության մարմնի վերոհիշյալ դատավարական բնույթի պարտականությունները նախատեսված են ոչ թե Օրենսգրքով, այլ ՀՀ կառավարության որոշմամբ, ինչն առերեւույթ հակասում է ՀՀ օրենսդրության պահանջներին:

Պետաիրավական հարցերի հանձնաժողովի նախագահ Գեւորգ Կոստանյանի խոսքով, այս օրինագծով մի կարեւոր հարց է լուծվում. «Գործող օրենսդրությամբ երբ գտնվում է  հետախուզման մեջ, նրա մեղադրանքը չես կարող փոխել: Պատկերացնենք անձին մեղադրանք է առաջադրվել՝ ծանր մեղադրանք, բայց քննությամբ պարզվում է,  որ ավելի մեղմ արարք է կատարել, բայց մեղադրանքը հնարավոր չէ փոխել, որովհետեւ Քրեական օրենսգրքը սահմանում է, որ մինչեւ անձը չներկայանա, չես կարող մեղադրանքը փոխել: Առաջարկվում է, որ եթե կան փոփոխելու հիմքեր, առանց նրա ներկայության էլ կարելի է փոխել»:

Նախագիծը հանձնաժողովի նիստում հաստատվեց եւ կներկայացվի ԱԺ քննարկմանը:
