Խնամատար կդառնան նաև 55-ից բարձր տարիք ունեցողները

ՀՀ ընտանեկան օրենսգրքի 138-րդ հոդվածի 6-րդ մասից կհանվի «երեխային խնամատարության հանձնելու պահին խնամատար ծնողներից յուրաքանչյուրի տարիքը չի կարող գերազանցել 55 տարին» ձևակերպումը:Արդյունքում՝ խնամատար ընտանիք կարող են դառնալ նաև 55-ից բարձր տարիք ունեցող ամուսինները։

Փոփոխության նպատակը երեխային խնամատարության հանձնելու պահին խնամատար ծնողներից յուրաքանչյուրի՝ 55 տարեկանը չգերազանցելու սահմանափակումը վերացնելն է, որը խոչընդոտ է խնամատար ծնող դառնալու ցանկություն հայտնած անձանց համար: 

Նախագծով առաջարկվող փոփոխության նպատակն է ապահովել առավել լայն հնարավորություն խնամատար ընտանիքի ինստիտուտի ընդլայնման համար: Փոփոխության անհրաժեշտությունը բխում է նաև երեխաների պաշտպանության համակարգում իրականացվող բարեփոխումներով, երեխաների` ընտանիքում ապրելու իրավունքի իրականացմամբ, ինչպես նաև խնամատար ընտանիքի ինստիտուտին վերաբերող գործընթացում առկա խոչընդոտի կանոնակարգմամբ:

Նախագծից տեղեկանում ենք, որ այսօր Հայաստանում խնամատար ընտանիքներում խնամվում են ընդամենը 27 երեխա: Մինչև 2018 թ․ վերջ խնամատար ընտանիքներում խնամվող երեխաների թիվը, պայմանավորված վերակազմավորման գործընթացի արդյունքում կենսաբանական, խնամակալ ընտանիք վերադարձի անհնարինության դեպքերով, նախատեսվում է եռապատկել՝ հասցնել այդ թիվը մինչև 94-ը:

ՄԱԿ-ի մանկական հիմնադրամի աջակցությամբ իրականացվող «Խնամատար ընտանիքում երեխայի խնամքի և դաստիարակության աջակցության տրամադրում» ծրագրի շրջանակներում իրականացվում է խնամատար ընտանիքներում երեխաների խնամքը կազմակերպելու նպատակով երեխաների և խնամատար ծնող դառնալու ցանկություն հայտնած անձանց համադրումը: Ծրագրի շրջանակներում վերապատրաստվել է Հայաստանի տարբեր մարզերի 73 խնամատար ծնող դառնալու ցանկություն հայտնած անձ:

Հետագայում պարզվել է, որ իրավակիրառ պրակտիկայում խնդիր է առաջացել ընտանեկան օրենսգրքի 138-րդ հոդվածի 6-րդ մասով, համաձայն որի՝ խնամատար ծնողի և հոգեզավակի տարիքային տարբերությունը պետք է լինի 18 տարուց ոչ պակաս և 50 տարուց ոչ ավելի, իսկ երեխային խնամատարության հանձնելու պահին խնամատար ծնողներից յուրաքանչյուրի տարիքը չի կարող գերազանցել 55 տարին: Այս սահմանափակումը խոչընդոտ է ստեղծել արդեն իսկ վերապատրաստված ծնողների, ինչպես նաև խնամատար ծնող դառնալու ցանկություն հայտնած անձանց խնամատար ծնող դառնալու համար և սահմանափակում է նրանց իրավունքները:

Մշակված նախագծի ընդունումը բխում է երեխաների իրավունքները պաշտպանելու, երեխայի՝ ընտանիքում ապրելու իրավունքիիրացումից։
