ՊԵԿ-ի նոր բացահայտումը. 300 մլն դրամի վնաս. «Փյունիկ» հիմնադրամում կատարվել են խուզարկություններ

«ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊԸ-ի կողմից անվճարունակության հատկանիշներ կանխամտածված ստեղծելու եւ հարկն առանձնապես խոշոր չափերով չվճարելու նպատակով՝ օրենքով սահմանված հաշվարկներում ակնհայտ կեղծ տվյալ մտցնելու դեպքի առթիվ ՊԵԿ քննչական վարչությունում ՀՀ քրեական օրենսգրքի 193-րդ եւ 205-րդ հոդվածների 2-րդ մասի հատկանիշներով 2018 թվականի մայիսի 2-ին եւ հունիսի 18-ին հարուցված քրեական գործերի նախաքննությամբ պարզվել է, որ ընկերությունը հիմնադրվել է 2010 թվականին:

ՊԵԿ-ից NEWS.am-ին հայտնում են, որ հիմնադիրներն  են՝ Գոռ Առաքելյանը` 20 տոկոս բաժնեմասով, ով 2011թ-ին իր բաժնեմասն օտարել է իր մորը` Լիլիթ Բագրատյանին, Գաբրիել Ղեմբերջյանը` 20 տոկոս բաժնեմասով, Նարեկ Սարգսյանը` 20 տոկոս բաժնեմասով եւ «Փյունիկ» բարեգործական հիմնադրամը` 40 տոկոս բաժնեմասով:

Ընկերությունը Երեւանի Բյուզանդի 3 հասցեում իրականացրել է բազմաֆունկցիոնալ շենքի կառուցապատում: 2013-2017 թվականներին իրականացրած գործունեության ընթացքում պետական բյուջե է վճարել ընդամենը՝ 3 միլիոն 527 հազար դրամ գումար, այն դեպքում, երբ պետության նկատմամբ ընկերության կողմից ներկայացված հաշվետվություններով առաջացրել է շուրջ 147 միլիոն դրամի հարկային պարտավորություն, սակայն դրանք չի վճարել եւ ընկերությանը տարել է սնանկացման: Բացի այդ, պարզվել է, որ «ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊԸ-ն իր գործունեության մասին հարկային մարմիններին 2016թ. 1-ին եռամսյակի վերաբերյալ ներկայացրած ԱԱՀ-ի հաշվարկում շուրջ 140 միլիոն դրամի չափով ԱԱՀ-ի գումար է թաքցրել:

Պարզվել է նաեւ, որ «ՋԼՋ Պրոյեկտ Քոմփանի» ընկերության 40 տոկոս բաժնետեր հանդիսացող «Փյունիկ» բարեգործական հիմնադրամի համահիմնադիր եւ տնօրեն է հանդիսանում Լեւոն Ազատի Սարգսյանն, ում որդին՝ Նարեկ Սարգսյանը, միաժամանակ «ՋԼՋ Պրոյեկտ Քոմփանի» ՍՊԸ-ի 20 տոկոս բաժնետեր է: Լեւոն Սարգսյանը նաեւ «Փյունիկ» բարեգործական հիմնադրամի հոգաբարձուների խորհուրդի անդամ է: Խորհուրդի մեկ այլ անդամ է «ՋԼՋ Պրոյեկտ Քոմփանի» ընկերության 20 տոկոս բաժնետեր Գաբրիել Ղեմբերջյանը: 

Ուշագրավ է նաեւ մեկ այլ հանգամանք, որ «Փյունիկ» բարեգործական հիմնադրամի իրավաբանական հասցեն է Երեւանի Երվանդ Քոչարի պողոտա, Սուրբ Գրիգոր Լուսավորիչ մայր եկեղեցին, սակայն, ըստ էության, ընկերությունը եկեղեցում գործունեություն չի իրականացրել, այլ փաստացի գործունեություն է ծավալել այլ հասցեում:

ՊԵԿ քննչական վարչության քննիչների եւ օպերատիվ հետախուզության վարչության աշխատակիցների կողմից 10 հասցեներում, այդ թվում՝ «ՋԼՋ Պրոյեկտ Քոմփանի» ընկերության հիմնադիրների բնակարաններում եւ «Փյունիկ» բարեգործական հիմնադրամի գրասենյակում կատարվել են խուզարկություններ:

Ընկերության կողմից պետությանը պատճառված վնասը կազմում է մոտ 300 միլիոն դրամ, որը հստակեցնելու, ինչպես նաեւ լրացուցիչ հարկային պարտավորությունների չափը պարզելու ուղղությամբ կատարվում են քննչական եւ դատավարական գործողություններ:

ՀՀ Սահմանադրության 21-րդ հոդվածի համաձայն` հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ օրենքով սահմանված կարգով՝ դատարանի՝ օրինական ուժի մեջ մտած դատավճռով:
