Այսօր, դատարանը Էդուարդ Բաբայանին կալանքի տակ պահելու որոշումը չի փոխել։
Թավշյա հեղափոխությունը դեռ չի «վարակել» դատական համակարգը, այստեղ դեռ անկախություն չկա։ Չնայած այն հանգամանքին, որ երեկ Հարությունովը իր հարցազրույցում մի քանի անգամ շեշտեց այն հանգամանքը, որ դատավորը ողջամիտ է, և պետք է որ ազատ արձակի Բաբայանին, կանխատեսումը չիրականացավ։
Մի ժամեր առաջ կայացած դատական նիստում՝ Բաբայանին կալանքի տակ պահելու որոշում կայացվեց։ Առաջանում է հարց, ի՞նչ հիմքերով են նրան կալանքի տակ պահում։
Դատարանը չի բավարարել գրավի դիմաց ազատ արձակման միջնորդությունը, սակայն այս օրերին ավելի լուրջ հանցագործներ՝ մեծ գումարների դիմաց, ազատ են արձակել։ Որտե՞ղ է արդարությունը։
 
Իսկ մեզ, հայերիս, թվում էր, թե հեղափոխությունը, նոր Հայաստանը կբացառեն նման երևույթները։ Առանց ապացույցների, առանց ցուցմունքի մարդ են կալանավորում և անգամ խոշոր գրավի դիմաց մերժում են ազատ արձակել, այն դեպքւոմ, երբ չկա անգամ դատաբժշկական փորձաքննության արդյունք:

Ի սկզբանե գիտեինք, որ Հարությունովը եղել է «Պրոմեդոլ» դեղի ազդեցության տակ, այն մթագնում է մարդու գիտակցությունը, տեսիլքներ է առաջացնում ընդունողի մոտ։ Հարությունովը հերքել էր իր տված ցուցմունքը, քանի որ այդ ընթացքում եղել էր նշված դեղի ազդեցության տակ։ Դա պետք է ենթադրեր, որ նրա ցուցմունքը հաշվի չեն առնի, հիմք չեն համարի, սակայն դատարանին դա չկանգնեցրեց և Բաբայանը մնաց կալանքի տակ։ 

Այդ դեպքում հարց է առաջանում, որո՞նք են Բաբայանին կալանքի տակ պահելու իրավական հիմքերը, կա՞ն արդյոք։ Իսկ միգուցե հիմքերը զուտ քաղաքակա՞ն են։ Սրանք հարցեր են, որոնք ակամայից ծագում են դատարանի տարօրինակ վճռից հետո:
