ՀՀ ԱԱԾ-ն մանրամասներ է ներկայացրել Թուրքիայի անչափահաս քաղաքացու նկատմամբ քրեական հետապնդումը դադարեցնելու վերաբերյալ

Հայաստանի Հանրապետության ազգային անվտանգության ծառայության քննչական վարչությունում 2018 թվականի  հուլիսի 25-ին հարուցվել է քրեական գործ` Թուրքիայի Հանրապետության անչափահաս քաղաքացու կողմից առանց սահմանված փաստաթղթերի ՀՀ պահպանվող պետական սահմանը ապօրինի հատելու դեպքի առթիվ:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ ԱԱԾ մամուլի կենտրոնից, ձեռք բերված տվյալների համաձայն` 16-ամյա  Ումուդ Ալի Մուստաֆայի Օզմենը 2018 թվականի հուլիսի 24-ին առանց պատշաճ թույլտվության հատել է ՀՀ պահպանվող պետական սահմանը` Թուրքիայի Հանրապետությունից անցնելով Հայաստանի Հանրապետություն, որից անմիջապես հետո «Մեղրաշատ» սահմանապահ ուղեկալի մոտակայքում`  սահմանային ինժեներա-տեխնիկական կառույցի փշալարերը հաղթահարելուց բռնվել է ՀՀ-ում ՌԴ ԱԴԾ սահմանապահ վարչության ծառայողների կողմից:

Ումուդ Ալի Մուստաֆայի Օզմենին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 329-րդ հոդվածի 1-ին մասի հատկանիշներով, խափանման միջոց է  կիրառվել կալանավորումը:

Քրեական գործի նախաքննության ընթացքում Ումուդ Ալի Մուստաֆայի Օզմենը զղջացել է կատարած արարքի համար, խոստովանական ցուցմունքներում նշել է, որ մշտապես ցանկություն է ունեցել գալ Հայաստան և համեմատել իր հայրենի Կարս նահանգի հետ, և քանի որ անչափահաս է ու սահմանված փաստաթղթեր չի ունեցել՝  միակ տարբերակը եղել է սահմանի ապօրինի հատումը:

Օպերատիվ-հետախուզական միջոցառումների և քննչական գործողությունների արդյունքում ստուգվել է Ումուդ Ալի Մուստաֆայի Օզմենի հնարավոր առնչությունը ծայրահեղական կամ ահաբեկչական կազմակերպությունների հետ, սակայն կապը հաստատող  տվյալներ չեն ստացվել:

Վարույթն իրականացնող մարմինը, առաջնորդվելով մարդասիրական սկզբունքներով և  հաշվի առնելով, որ Ումուդ Ալի Մուստաֆայի Օզմենը անչափահաս է, տվել է ճշմարտացի տեղեկություններ դեպքին հետ կապված բոլոր հանգամանքների վերաբերյալ ու անկեղծորեն զղջացել է կատարվածի համար, 2018 թվականի սեպտեմբերի 25-ին որոշում է կայացրել Ումուդ Ալի Մուստաֆայի Օզմենի նկատմամբ քրեական հետապնդումը դադարեցնելու, քրեական գործով վարույթը կարճելու մասին:  Կիրառված խափանման միջոց կալանավորումը վերացվել է, Ումուդ Ալի Մուստաֆայի Օզմենին հնարավորություն է տրվել սահմանված ընթացակարգով մեկնել ՀՀ-ից:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
