Այսօր հայտնի դարձավ, որ ձերբակալվել է « Սպայկա» ընկերության տնօրեն Դավիթ Ղազարյանը: Orer.am-ին ՊԵԿ տեղեկատվության և հասարակայնության հետ կապերի բաժնից հայտնեցին, որ ՊԵԿ քննչական վարչության աշխատակիցների կողմից կոռուպցիոն բնույթի հանցագործությունների բացահայտման ուղղությամբ ձեռնարկված անհետաձգելի օպերատիվ-հետախուզական և քննչական միջոցառումների արդյունքում բացահայտվել է առանձնապես խոշոր չափերով հարկերը չվճարելու դեպք և 2019թ. ապրիլի 4-ին Դավիթ Ղազարյանին մեղադրանք է առաջադրվել  ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 2-րդ մասով:

Պարզվել է, որ «Սպայկա» ընկերության տնօրենի անմիջական մասնակցությամբ ԵԱՏՄ անդամ պետություններ չհանդիսացող եվրոպական տարբեր պետություններից,  այդ թվում՝ Լեհաստանից, Բելգիայից, 2014-2015 թվականների ընթացքում ընկերության միջոցով ձեռք է բերվել դեպի Հայաստան փոխադրման և ներմուծման ենթակա պանիր,  տանձ, խնձոր, չինական կաղամբ, լոլիկ և այլ ապրանքներ, որոնք 2015-ի հունվարի 1-ից  մինչև 2016-ի հունվար Վրաստանի տարածքով ներմուծվել է Հայաստան:

Իրականացված ներմուծումների ժամանակ նշված ապրանքների խմբաքանակները Վրաստանի  մաքսային սահմանից դեպի Հայաստան արտահանելիս, Վրաստանի մաքսային մարմիններին ներկայացրել են ապրանքատեսակների իրական անվանումները,  քաշը, արժեքը, ծագման երկիրը,  մատակարար և գնորդ կազմակերպությունների անունները և այլ իրական տվյալներ պարունակող փաստաթղթեր: Այդ թվում՝ ինվոյսներ, սակայն Հայաստան ներմուծելիս՝ ՀՀ մաքսային մարմիններին ներկայացրել են կեղծ փաստաթղթեր, թե իբր ներմուծված ապրանքները բացառապես մաքսատուրքի և ավելացված արժեքի հարկի հաշվարկումից և վճարումից ազատված ապրանքատեսականի է:   Որպես ներմուծող կազմակերպություն հանդես է եկել «Սպայկա» ընկերության տնօրինության կողմից կառավարվող «Գրինպրոդուկտ» ՍՊԸ-ն:

Արդյունքում, երրորդ երկրներից ներմուծված ապրանքները ՀՀ-ում մաքսազերծել է այլ ապրանքատեսականու անվան տակ, որոնց մաքսազերծումն ազատված է մաքսատուրքի և ավելացված արժեքի հարկի հաշվարկումից և վճարումից:

Փորձագիտական եզրակացության հիման վրա, միայն 2015-ի հունվարից մինչև 2016-ի հունվար, այդ  եղանակով «Սպայկա» ընկերության ուղղակի դիտավորությամբ նպատակ հետապնդելով չվճարել  հարկերը, տուրքերը և պարտադիր այլ վճարները, պետական բյուջե չի վճարել մոտ 7 միլիարդ  36 միլիոն դրամ մաքսատուրք և հարկ: 2016 թվականի մնացած ամիսների, ինչպես նաև 2017 և 2018 թվականների մասով պետությանը պատճառված վնասը պարզելու համար քննչական և դատավարական գործողությունները շարունակվում են:

Քրեական գործի նախաքննությունը շարունակվում է, ձեռնարկվում են անհրաժեշտ օպերատիվ-հետախուզական, քննչական, ինչպես նաև դատավարական  միջոցառումներ՝ վերը նշված հանցավոր գործունեության մասնակից հանդիսացած անձանց գործողություններն անհատականացնելու, ինչպես նաև պետությանը պատճառված վնասի վերջնական չափը հստակեցնելու ուղղությամբ:
